To Whom It May Concern:

This is a request under the Freedom of Information Act. I hereby request the following records:

All FBI policy documents outlining the requirements for a pilot to have acceptable "flight currency" to operate an unmanned aerial system.

The OIG report published on March 25 noted: "Since 2009, FBI aviation policies governing the operation of UAS have required that UAS pilots maintain what is referred to as “flight currency” by performing three successful launches and recoveries of a particular UAS model within the 90 days preceding an operation with that type of UAS."

Given that this FOIA is submitted in my capacity as a journalist who has covered drones and the FBI extensively, I request that I be categorized as a media requester for the purpose of fees. Here is a selection of my published articles on drones:

As the requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com and pertains to a matter of considerable public interest, I further request a full waiver of all fees.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Shawn Musgrave

Dear Mr. Musgrave,

In regards to FOIA 1325977, you did not specifically ask in your original request letter for fees to be waived, therefore, it was not treated in a manner where we would consider waiving fees. Looking at your other FOIA that is currently being processed, FOIA 1266334-0 the fees were waived. We will continue to honor this as the requests are similar in nature.

Thank you,

Hello -

Respectfully, I did request a fee waiver in the present FOIA request, 1325977-000, as well as to be classified as a reporter for the purpose of fees.

Regarding classification as a media requester, I included links to several articles as evidence of my publication history relevant to the subject of this FOIA request. I would be happy to send again if this would help. Please confirm that I have been appropriately categorized as a media requester for the purpose of fees.

Best,
Shawn Musgrave
