Pursuant to RCW Ch. 42.56 (Public Records Act), I hereby request the following records:

All letters received by members of Seattle City Council on Friday, March 15, 2013, from John A. Diaz #4497, Chief of Police, Seattle Police Department, concerning Council Bill 117730, regulating the acquisition and use of surveillance equipment by city departments. This should include but not be limited to the letter referenced by Councilmember Bruce Harrell during the [March 18, 2013, Council Briefing][1], when he said to other council members, "Many of you might have received a letter from the chief on March 15th that captured a paragraph that the police department wanted in," then later said, "Getting back to the letter that the chief had sent to us, requesting this paragraph. It should be very clear: This entire paragraph is in the legislation."

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I request that any redactions be made by "blacking out" rather than "whiting out."

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

In accordance with RCW 42.56.520, this e-mail acknowledges receipt of your Public Records Request dated March 19, 2013 and received by each of the following separate Seattle City Council Offices: Tim Burgess, Sally Bagshaw, Sally Clark, Nick Licata, Jean Godden, Bruce Harrell, Tom Rasmussen, Richard Conlin, and Mike O'Brien. Please consider this a coordinated initial response on behalf of each Council Office. As the Public Records Officer for the Legislative Department, which includes the Office of the City Clerk and Seattle City Council, I will coordinate the response to your request and serve as the point of contact for any related communication or questions. In your email, you requested the following:

All letters received by members of Seattle City Council on Friday, March 15, 2013, from John A. Diaz #4497, Chief of Police, Seattle Police Department, concerning Council Bill 117730, regulating the acquisition and use of surveillance equipment by city departments. We are currently in the process of searching, identifying and gathering potentially responsive documents. Our office estimates it will take approximately four weeks to complete a thorough search of its records due to the current volume of public records requests. We anticipate providing any responsive records on April 23, 2013. Of course if we complete our search sooner, any responsive records will be made available at that time.

Dear Mr. Mocek:

As a follow-up to my email of March 26, 2013 please find attached an initial installment of records in response to your public records request for "all letters received by members of the Seattle City Council on Friday, March 15, 2013 from John A Diaz #4497, Chief of Police, Seattle Police Department, concerning Council Bill 117730, regulating the acquisition and use of surveillance equipment by city departments."

Today's production of records includes communications received by Council President Sally Clark, Council members Nick Licata, Tom Rasmussen, Mike O'Brien, Bruce Harrell, Sally Bagshaw and Tim Burgess.

We are continuing our search and review of the communications of councilmembers Jean Godden and Richard Conlin. We are continuing to use the following search terms and parameters: "John Diaz," "Council Bill 117730," and "surveillance equipment" for the periods of March 15, 2013 to March 15, 2013. This includes a thorough search of hard copy and electronic records. We anticipate finalizing our response on or before May 10, 2013.
