It has been over 5 business days since my request was denied, and the District has not responded to or otherwise acknowledged my request. Therefore, it is deemed denied in its entirety. Dear OOR:
I respectfully request that OOR withdraw its Final Determination and sustain this appeal. Party submissions in this appeal are open until January 27, so this request is timely.
Here is the reason for my request: as set forth in the accompanying declaration, I have received no communications of any kind from the District since I filed my original RTKL request on December 23, 2019. And per the official appeal notice, ORR may not consider any submissions presented ex parte. Therefore, ORR should disregard the District's submissions and sustain this appeal.
To be clear, I am not attributing any improper motive to the District or its counsel. Had I received any notice from the District that it intended to invoke a 30-day extension, I would not have filed this appeal. But because I received no such notice, I assumed that my request had been deemed denied. I sincerely hope that this communication issue can be resolved so as to prevent similar miscommunications in the future.
