Pursuant to the Washington Public Records Act, I hereby request the following records:

Investigation findings (determination records only) for allegations of any crime according to Washington RCW statutes, committed by University of Washington (Seattle campus) employees in teaching, supervisory, managerial, and executive management roles, from January 2010 to present.

"The PRA protects “privacy,” it allows withholding only if disclosure: (1) would be highly offensive to a reasonable person, and (2) is not of legitimate concern to the public. This two-part test requires proof of both elements. King County v. Sheehan (2002)."

Therefore, this request seeks the release of the above specified records, regardless of the investigation outcome, that are of legitimate concern to the public, that would reveal the performance of a public agency, and/or would not be offensive to a reasonable person.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

The University does not conduct investigations into criminal activities as defined under Washington State Law. Investigations at the University are conducted regarding violations of University policy. Therefore, the University has no records of investigations into criminal activity.

My request is not asking for UW criminal investigations, although you do have a police department that investigates crimes on your campus that would have records. Therefore you would be in violation of the law by stating that the University has no records regarding criminal complaints on UW employees in the aforementioned roles within the aforementioned time period.

I am not required to submit an additional request as a result of your refusal to comprehend the legitimate request that I have now submitted three times.

Please reopen this request and release the outcome of investigative records, either from UCIRO, UW Seattle Title XI office, UW Seattle Safe Campus, UW Seattle Human Resources, UW Seattle Police, or any other UW office that investigates complaints that are specified in my request.

To Ann Anderson,

Thank you for the response. I'm struggling with the idea that the University of Washington Human Resources office does not have documentation regarding police investigations of its employees. I believe that if an employee was to be disciplined counseled or terminated for an illegal action, that the human resources office would receive documentation supporting the decision. That documentation would fall within my records request, even if it's a copy that HR received from the police investigation. I appreciate you taking the time to review my appeal.

As per the University's March 6, 2019 response to your appeal dated January 4, 2019, this email is provided in supplemental response to your clarified public records request for UW Police Department records for any crime allegations committed by UW Seattle employees in certain roles, from 2010 to present.

Upon review, the Office of Public Records and Open Public Meetings has found certain items partially exempt from inspection and copying and has made the appropriate redactions per the following Public Records Act provision(s):

RCW 42.56.230(5) CREDIT CARD AND BANKING INFORMATION
The following personal information is exempt from public inspection and copying under this chapter: (5) Credit card numbers, debit card numbers, electronic check numbers, card expiration dates, or bank or other financial information as defined in RCW 9.35.005 including social security numbers, except when disclosure is expressly required by or governed by other law.

RCW 42.56.240(2) VICTIM AND/OR WITNESS INFORMATION
The following investigative, law enforcement, and crime victim information is exempt from public inspection and copying under this chapter: (2) Information revealing the identity of persons who are witnesses to or victims of crime or who file complaints with investigative, law enforcement, or penology agencies, other than the commission, if disclosure would endanger any person's life, physical safety, or property. If at the time a complaint is filed the complainant, victim, or witness indicates a desire for disclosure or nondisclosure, such desire shall govern.
