Pursuant to the Washington Public Records Act, I hereby request the following records:

AtNight Media (formerly Original Media Group) requests audio files of any jail or prison visits and phone calls placed by inmate Brian Kohberger, who is awaiting trial for four counts of first-degree murder and one count of burglary after being charged in a high-profile criminal indictment on Dec. 29, 2022. The defendant was extradited to Idaho, where he was formally charged on Jan. 5.

1. Any memos, documents, reports, and other material the Agency would generally provide to the public through members of the media relating to “Bryan Kohberger” (born November 21, 1994) from 2008 to November 29, 2022.
2. Any email sent or received between Oct. 1, 2015 to Jan. 1, 2023, which includes the keyword “Bryan Kohberger”.

Similarly, if the requested data are available only in part, please fulfill the portion of the request that is available rather than denying it in full. For example, notes or reports are available/subject to release but personal identifying information are not, reply with the report summary and omit sensitive information.

AtNight Media is a representative of the news media and is primarily engaged in the dissemination of information to the public.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

20 USC § 1232g, RCW 42.56.070(1) and RCW 42.56.510

 

Education records have been withheld from release in with 20 USC § 1232g of the Family Educational Rights and Privacy Act (“FERPA”), which ensures the confidentiality of students’ personally identifiable information, as defined in 34 CFR § 99.3; and RCW 42.56.070(1) and RCW 42.56.510, which affirm the applicability of other statutes with regard to exempt information.

 

Records protected under FERPA may be released with the prior written consent of the student (or parent, if the student is under 18 years of age). If you are requesting records with the student’s consent, please return the attached FERPA waiver by 5pm Pacific Standard Time on August 9, 2023. If a FERPA release has been submitted to another WSU office, please let us know. If we do not receive the notarized waiver by 5pm Pacific Standard Time on August 9, 2023, the FERPA protected portion of the request will be closed. Any subsequent requests for the same materials will be treated as a new request.

Records that are not exempt under FERPA will be processed with an estimated due date of August 31, 2023.
