We estimate it will take 10 business days or until about September 14, 2017, to gather, review, and copy any available records, should they exist.

We will contact you again when we have found the records and tell you of any charges. If records can be gathered and provided electronically there is no charge. However, under WAC 314-60-090, we may charge 15 cents per page for regular copies plus postage or 5 cents per page for scanned records provided electronically. If there is a charge, we will send you the records after we receive a check made out to WSLCB for the amount due. You may also review the records free of charge at our office if you prefer.

After performing a search of our systems, we have determined that we do not have a single record that shows the racial, gender, criminal background, and economic demographics of those approved for both marijuana worker and retailer licenses. Please note that we do not track the racial, gender, criminal background, and economic demographics of retail employees, therefore, we must respectfully deny your request for those records. The WSLCB must only provide existing records and does not have to create records to respond to a public records request per RCW 42.56.080.

We will note for you that there was a study conducted regarding marijuana retailers and race. These records will be available for you to download for the next 30 days. No records have been redacted or withheld.

Please note that there are additional records in licensing application packets that may show criminal background, gender, and economic demographics of retail licensees. Alternatively, you may wish to request the entire licensing application packets for approved marijuana retail licensees, which would include all documents provided to the WSLCB in order to be licensed. Please note that those packets typically range anywhere from 200-500 pages per business entity. In an effort to assist you, we have attached the Marijuana Applicants List to this correspondence, which shows all approved marijuana retail licensees. There are 756 approved marijuana retail licensees.

Please let us know within five business days or by September 21, 2017 what specific identifiable public records you are seeking. If no response is received from you, we will interpret you to be seeking the Personal Criminal History Statements and Financial Statements for all approved marijuana retail licensees. We estimate that we can provide you with records related to 50 licensees per installment, with an installment being provided approximately every 15 business days. We estimate it will take 226 business days or until August 9, 2018 to fully complete your request. However, we estimate that we will be able to provide you with an installment of those records in 10 business days or by September 28, 2017. Please note that if you are seeking the entire licensing application packets, we will need to adjust this estimated completion date.
