To Whom It May Concern:

Pursuant to RCW Ch. 42.56 (Public Records Act), I hereby request the following records:

The racial, gender, criminal background, and economic demographics of those approved for both Marijuana worker and retailer permits.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Sincerely,

Samuel Sinyangwe

Dear Samuel Sinyangwe:

The Washington State Liquor and Cannabis Board (WSLCB) received the attached public records request from you on August 23, 2017. This letter responds to your request under RCW 42.56.520 and WAC 314-60-085. Please use the above Request ID# when contacting us about this request. We recommend that in the future you forward records requests to our general request email publicrecords@lcb.wa.gov<mailto:publicrecords@lcb.wa.gov>, rather than any individual staff to ensure proper tracking, timely processing, and to avoid unintentional delays in processing your request.

You asked for copies of the following records: "racial, gender, criminal background, and economic demographics of those approved for both Marijuana worker and retailer permits."

We estimate it will take 10 business days or until about September 14, 2017, to gather, review, and copy any available records, should they exist.

We will contact you again when we have found the records and tell you of any charges. If records can be gathered and provided electronically there is no charge. However, under WAC 314-60-090, we may charge 15 cents per page for regular copies plus postage or 5 cents per page for scanned records provided electronically. If there is a charge, we will send you the records after we receive a check made out to WSLCB for the amount due. You may also review the records free of charge at our office if you prefer.

If you have any questions, please feel free to contact me. Thank you.

Dear Samuel Sinyangwe:

This letter further responds to your public records request. Washington State Liquor and Cannabis Board (WSLCB) received your request on August 23, 2017. We last wrote to you regarding your request on August 30, 2017.

After performing a search of our systems, we have determined that we do not have a single record that shows the racial, gender, criminal background, and economic demographics of those approved for both marijuana worker and retailer licenses. Please note that we do not track the racial, gender, criminal background, and economic demographics of retail employees, therefore, we must respectfully deny your request for those records. The WSLCB must only provide existing records and does not have to create records to respond to a public records request per RCW 42.56.080.

We will note for you that there was a study conducted regarding marijuana retailers and race. Those records are available for you to download at the following link: https://lcb.box.com/s/1jimzxy778186mxf6yokm42kor1spyyh. These records will be available for you to download for the next 30 days. No records have been redacted or withheld.

Please note that there are additional records in licensing application packets that may show criminal background, gender, and economic demographics of retail licensees. Records that we believe would contain this information are Personal Criminal History Statements and Financial Statements. Examples of these forms are attached. Codes appear within the redactions on the records, and the basis for these exemptions is briefly explained as follows:

Code

Exemption

Brief Explanatory Description

Statutory Basis

FinInfo

Financial Account Numbers Liquor and Marijuana License Application

Financial Information, including but not limited to account numbers and values, on liquor license and marijuana applications are exempt from disclosure

RCW 42.56.230(5) and RCW 42.56.270 (10) (a)

SS#

Social Security Number

Social Security Numbers are exempt from disclosure.

RCW 42.56.510 and 42 USC Section 405(c) (2) (C) (viii) (1)

DriverLic#

Driver's License Numbers

Any record pertaining to a vehicle license plate, driver's license, or identicard issued under RCW 46.08.066 that, alone or in combination with any other records, may reveal the identity of an individual, or reveal that an individual is or was, performing an undercover or covert law enforcement, confidential public health work, public assistance fraud, or child support investigative activity.

RCW 42.56.230(7)(c)

Are you wanting to request these forms for all approved marijuana retail licensees? Alternatively, you may wish to request the entire licensing application packets for approved marijuana retail licensees, which would include all documents provided to the WSLCB in order to be licensed. Please note that those packets typically range anywhere from 200-500 pages per business entity. In an effort to assist you, we have attached the Marijuana Applicants List to this correspondence, which shows all approved marijuana retail licensees. There are 756 approved marijuana retail licensees.

Please let us know within five business days or by September 21, 2017 what specific identifiable public records you are seeking. If no response is received from you, we will interpret you to be seeking the Personal Criminal History Statements and Financial Statements for all approved marijuana retail licensees. We estimate that we can provide you with records related to 50 licensees per installment, with an installment being provided approximately every 15 business days. We estimate it will take 226 business days or until August 9, 2018 to fully complete your request. However, we estimate that we will be able to provide you with an installment of those records in 10 business days or by September 28, 2017. Please note that if you are seeking the entire licensing application packets, we will need to adjust this estimated completion date.

If you have any questions, please contact me. Thank you.

Sincerely,
