Attached is a copy of our third party notice and INIT's request for additional time. Thanks for the update. I am surprised to learn that Sound Transit and INIT are engaging the third-party notice and TRO process at this stage, and wanted to clarify the intent behind this request. My intent was to learn which documents INIT and Sound Transit consider to be secret under RCW 42.56.540 -- not to request the secret documents themselves. I understand, from experience, how much of a hassle the RCW 42.56.540 procedure can be for everyone, and my entire goal was to avoid creating that hassle here.
That said, if Sound Transit and INIT consider the parameters of secrecy to be secret themselves, I suppose you know how to reach me with legal process. Please recall that when this happened with the Vix request, the Court found that delays that "occur without any real reason" are a violation of the PRA.

Dear Kevin Wallace,
Thank you for the email clarification to your records request dated February 8, 2024 – 6:12 PM, received by Sound Transit on February 9, 2024 (the “Original Request”). The Original Request stated that you were seeking “any agreement with [INIT] or documentation that contemplates RCW 42.56.540.” Your clarification email stated that your intent was to “learn which documents INIT and Sound Transit consider to be secret under RCW 42.56.540 – ” (emphasis added). In response to your clarification email, please be advised that Sound Transit is not the custodian of any record that identifies or lists documents that INIT/Sound Transit “consider to be secret under RCW 42.56.540.” not to request the secret documents themselves
Prior to your clarification email, Sound Transit identified the following documents that we (at the time) believed were potentially responsive to the Original Request: (1) the INIT/Sound Transit Contract; and (2) Change Orders 1-15 to the INIT/Sound Transit Contract. Following Sound Transit’s receipt of the Original Request, but prior to the clarification email, Sound Transit sent these documents to INIT for review.
Because your clarification email states that you are not “request[ing] the secret documents themselves,” and Sound Transit is not the custodian of any record that identifies or lists documents that INIT/Sound Transit “consider to be secret under RCW 42.56.540,” Sound Transit is closing this file.
However, please advise us if you decide that you would in fact like to receive the above-referenced INIT/Sound Transit Contract and Change Orders 1-15.
