Pursuant to the Freedom of Information Act, I hereby request the following records:

I seek any and all documents in the agency's possession that pertain to the WikiLeaks website or organization from January 2006 to the present date, including but not limited to emails, memos, notes, briefings, reports and other documents related to, mentioning or generated as a result of:

* guidance and instructions for employees regarding visiting the website or otherwise reading or learning about it in the news

* internal reactions to the website's existence and disclosures

* damage reports regarding the website and its disclosures

* efforts to identify, investigate and/or mitigate potential leaks to the website

* efforts to identify, investigate and/or mitigate potential unauthorized viewing of the website or news reports analyzing it and/or its contents

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

I am not seeking records for "the entire Agency." I am seeking only records within FinCEN, which is required to perform a search.

You cannot categorically state that all records originate with the rest of the Treasury department, especially since the request specifically requested "emails, memos, notes, briefings, reports and other documents related to, mentioning or generated as a result of..." the materials which was claimed would only originate from the Agency.

FinCEN materials "generated as a result of" documents originating from the Agency would be in FinCEN's possession, not the Agency's. As such, FinCEN is required to perform a search.

Moreover, the request was submitted on 5/19/2019, not 10/09/2020 as was claimed. 10/09/2020 was when I submitted a follow-up to the original submission. I am appealing the response in its entirety. I am not seeking records for "the entire Agency." I am seeking only records within FinCEN, which is required to perform a search.

This is in follow up to your letter addressed to FinCEN dated November 21, 2023, which we received on December 18, 2023. As you know FinCEN is a bureau of the U.S. Department of the Treasury. At FinCEN when the there is a reference to the Agency that means The Department of Treasury (Main Treasury). Therefore, when your request asked for, "...any and all documents in the agency's possession that pertain to the WikiLeaks website" we informed you that you would have to go to the Department of Treasury for your request.

Your letter is marked as an appeal. Do you want to appeal, or would you like a search to be conducted by FinCEN?

As for when we received your request, although you may have sent the request in May of 2019, the request went to Main Treasury, and we did not receive it from them until October of 2020.

We received your appeal for request #21-005. On December 11th an email was sent to you regarding request 21-005. In no part of that letter did it state anything about the agency. A search was conducted on the information for 21-005 and no records were found . Attached to this email is the original email sent to you with our final response letter and the actual response letter. Please respond to us within 10 business days otherwise we will consider the matter closed/withdrawn.
