All records, on, about, mentioning, or concerning any of the following:
1) Artle B. Spencer, whom was a former USDA employee, born 6/12/1908 in Tecumseh, Oklahoma. He was a NACC Poultry Grader, Consumer Marketing Services, poultry division, U. S.Department of Agriculture, Springdale, Arkansas;
2) AUDREY VERNICE SPENCER, wife of former USDA employee Artle B. Spencer. Audrey was accused of having an improper relationship with Tyson foods where she was hired as an art consultant from 1965 to 1967 while her husband was a USDA inspector responsible for the Tyson plant.
3) Tyson foods where the records concern bribes, potential bribes, investigations of possible bribes, or any related conduct.
4) Donald John Tyson (aka: Don Tyson), where the records concern bribes, potential bribes, investigations of possible bribes, or any related conduct.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Please allow me to respond to the four points you raised concerning this FOIA request:
1) I am looking for records concerning Mr. Spencer, not records he created. Personnel files and internal investigations should be included. According to FBI records, Mr. Spencer was investigated for having a conflict of interest with Tyson while working for the USDA. I would like such records included. I do not know the meaning of NACC, as it was obtained from the FBI file without any further explanation in that file. I do not have dates of employment, but they would include 1965 to 1967. Mr. Spencer is dead and the privacy act does not apply.

2) I would expect that you have records concerning AUDREY VERNICE SPENCER that would have been accumulated while investigating Mr. Spencer's conflict of interest.

3) You can limit the search for records on tyson foods to the years 1965-1975. Include all investigations where Tyson foods is concerned. I hope to find the case including Mr. Spencer as well as any other cases from this time period.

4) You can limit the search for records on don tyson to the years 1965-1975. Include all investigations where Tyson foods is concerned. I hope to find the case including Mr. Spencer as well as any other cases from this time period. Don Tyson was a famous person, whose death is well know and can quickly be confirmed with a google search or a search of any major news service. The privacy act does not apply to the deceased.

Your FOIA request below has been referred to USDA's Agricultural Marketing Service (AMS). Because the records you seek are quite old (i.e., from between 1965 and 1975), it is highly unlikely any of these records would continue to reside at USDA headquarters. Instead, it is most likely that any such records, if they still exist, would be housed at the National Archives and Records Administration (NARA) in a records storage facility. I believe Ms. Valerie Emmer, the AMS FOIA Officer, is researching your request and will contact NARA to determine if such records may still exist and can be located.
