Pursuant to the Freedom of Information Act, I hereby request the following records:
Records relating to the investigation of a leak at Rand, presumably relating to Ellsberg and the Pentagon Papers. The existence of this probe has been previously disclosed, including in the attached document from Judiciary Committee Hearings: Statement of Information Submitted on Behalf of President Nixon, Book IV - White House Surveillance Activities.
Note that I am, for the THIRD TIME, requesting additional records not previously processed. As I am a member of the news media and you will not be fulfilling the request within the time limit, you are barred from levying fees which you and DOJ previously cited as a reason for the constructive denial of my previous request, despite having never even requested fees. If you proceed to do this again, I would be absolutely DELIGHTED to pursue this in court.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

I am appealing the decision to not grant the fee waiver request for this file, for which there is an obviously amount of public interest both in the material and the government's handling of it. If the Bureau felt more information was needed for the fee waiver request, it should have communicated this and asked for the additional information.
