Dear Mr. Best,

The FBI has received your additional correspondence regarding your Freedom of Information Act/Privacy (FOIPA) request and it has been forwarded to the assigned analyst for review. If appropriate, a response will be forthcoming.

I was able to access the proof of death link you provided, but in the future please attach a copy of the actual documentation to your request (i.e., as a .pdf or word document) rather than simply providing a link. We are not always able to access links provided by requesters.

An acknowledgement letter, stating the request is being processed.

From: Federal Bureau of Investigation

A letter stating the requester must agree to or prepay assessed or estimated fees in order for the agency to continue processing the request.

From: Emma Best

It is highly improper to request payment here, as I am a member of the news media (as recognized by the Bureau and agreed to by the DOJ) and the page count is less than 5,000 pages yet is not being provided in the time limit required by statute. As a result, I am not to be charged for duplication of any materials less than 5,000 pages in total. As the total page count you cite is well below 3,500 pages, I am to be exempted all duplication fees. Please confirm and proceed with processing.

From: FOIPAQUESTIONS

Dear Mr. Best,

I consulted with the assigned analyst for your request, and you are correct; no duplication fees should apply. You may disregard the cost letter for 1362506-000.

If you require further assistance, please contact foipaquestions@fbi.gov<mailto:foipaquestions@fbi.gov>.

From: Federal Bureau of Investigation

Good afternoon Ms. Best,

Reference is made to your Freedom of Information Act (FOIA) request # 1362506-000 for FBI records concerning Rafael Villaverde. The FBI has located approximately 3,263 pages that are potentially responsive to your request. Once requests go over a certain size, usually in the 50-100 page range, they become increasingly complex, greatly slowing down the time required for processing. Generally the larger the file, the longer it takes to process. Given our current workload and staffing levels, it may be a very long time before you would begin to receive material from this request.

We contact requesters with requests of this size to see if there might be a way to possibly narrow the scope. Is this something you might be willing to consider? If so, please contact me and we can discuss this possibility. We appreciate your patience and hope to hear from you soon.
