To Whom It May Concern:

This is a request under the Freedom of Information Act. I hereby request the following records:

A list of all Memorandum of understanding (MOU) and Memoranda of Agreement (MOA) between your agency and any other agency or department. I am not asking you to create a listing, but rather, I understand that your agency maintains a listing.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Jason Smathers

Mr. Smathers,

FAA cannot accept this request for processing. It is very broad and would
require assignment to every office in the agency. Contrary to your belief
the agency does not maintain a listing of memoranda of understanding or
agreement.

You may limit the search to offices which can enter into agreements on behalf of the entire agency and the locations such records would be kept. In an absence of a listing, I request, in the alternative a copy of each MOU/MOA created in 2013. Although I understand you are not required to create records under the FOIA, if you exercise your discresion to create a listing of the responsive records, I would accept that instead of each MOU/MOA.

From: Federal Aviation Administration

Mr. Smathers,

I am sorry, but your request is still too broad. It would require
assignment to every office in the agency. Could you identify a topic or
functional office?

From: Federal Aviation Administration

Good afternoon Mr. Smathers-

Upon receipt of your request, I searched our records and referred to other
offices to locate a "master list" of Air Traffic Organization (ATO)
Memorandum of Understanding and Memorandum of Agreement documentation, but
I have been advised there is no list of these records. The ATO is a very
large organization, with numerous offices and facilities all around the
country, the sheer volume of records for search and review time would be
extremely expensive. Therefore, I am requesting you that you clarify your
request so that I am able to provide you what you are seeking.

Please indicate the subject or office of interest you would like these
records from. If you have questions, do not hesitate to call me to
discuss your search parameters and I will help you. Be very specific
indicating what you are looking for to reduce your costs and wait time, as
well as, ensure we will provide the information you are seeking.. Once I
have that information, I will contact the appropriate office(s) to begin
the search for records.

I look forward to your response, however, if you do not respond by April
21, I will consider that you are no longer interested and close the
subject FOIA request.

Good evening Mr. Smathers-

I sent the attached message on March 24, and I have not received a
response from you. This is a second attempt to clarify your request after
providing the additional information below.

Please contact me as soon as possible at the telephone number below to
discuss your request. As a reminder, if we do not receive a response by
April 21, we will consider your request withdrawn and no further action
will be necessary.

I look forward to speaking with you.
