I am appealing the decision to ignore the explicit scope of the original request, which stated " If previously released
records are available, then I request a rolling release consisting of those records while additional records are located and processed for release." The Bureau's decision to instead provide preprocessed records and close the request is therefore entirely inappropriate, as is the requirement that I file a second FOIA request restating the explicit scope of the original FOIA request simply to have a search conducted. This is inconsistent with both the caselaw and the FOIA statute itself, and is yet another indication of the Bureau's systemic indifference or incompetence when it comes to processing FOIA requests. This was not – and never has been – a matter of ambiguity or the Bureau failing to understand the intent of the request – it is a deliberate choice to ignore or subvert it, or at best complete and utter incompetence (but Hardy is an honorable man, so are they all, all honourable men).
