DearThe FBI has received your Freedom of Information Act/Privacy (FOIPA) request. Before we can process your request you must complete and submit the U. S. Department of Justice (Certification of Identity) Form DOJ-361. Privacy Act requests (records about yourself); requires an original and legible signature, and the “penalty of perjury statement” which is included on the Form DOJ-361.

If you do not wish to use the Form DOJ-361, your request must be accompanied by a notarized signature or a statement signed under penalty of perjury stating that you are the person that you say you are. The statement should be above your signature and state, “I declare under penalty of perjury that the foregoing is true and correct. Executed on [date].”

The Form DOJ-361 is available at http://www.fbi.gov/ under the Freedom of Information Act/Privacy link, or http://www.fbi.gov/foia/. The form may be mailed or faxed to the FBI at the address/number below. A scanned copy is acceptable if sent by electronic means but the FBI does not accept electronic signatures. You may submit an attachment listing additional information that may aid in locating responsive records. Please place your name and contact information on the attachment.

If you require additional assistance please contact me.

Thank you,

Dear Beryl Lipton,

Before the FBI is able to proceed with your Freedom of Information Act/Privacy (FOIPA) request pertaining to another individual(s), we require that you submit either proof of death or the U. S. Department of Justice CERTIFICATION OF IDENTITY (Authorization to Release Information to Another Person)-Form DOJ-361, from the subject(s) of your request. The form is available at http://www.fbi.gov<http://www.fbi.gov>/, by accessing the Freedom of Information Act/Privacy link or at http://www.fbi.gov/foia/<http://foia.fbi.gov> or http://www.justice.gov/oip/. Without proof of death or the privacy release, the disclosure of third-party information contained in law enforcement records, should they exist, is considered both a clearly unwarranted invasion of privacy pursuant to Exemption (b)(6), U. S. C. § 552, and an unwarranted invasion of personal privacy, pursuant to Exemption (b)(7)(C), 5 U.S.C. § 552.

The information may be mailed to the address below or faxed to: (540) 868-4391/4997. A scanned copy is acceptable if sent by electronic means but the FBI does not accept electronic signatures.

From: Jason Smathers

These four people are infamous for their attempted escape from Alcatraz. All four are presumed dead and because their deaths are commonly known, no proof is required.

West died while in federal custody on December 21, 1978, at the age of 49. The FBI concluded in their own investigation of the escape that Morris and the Anglin brothers drowned in the escape attempt. Therefore, the death of these individuals is well known to both the public and to the FBI and proof of death is not required.

Please proceed with processing this request.

In my initial request, I asked for a fee waiver and said "In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request." It seems that you have split my initial request into multiple requests and assessed each request $25 in search fees. Since I did not agree to these search fees, please release all records that were obtained within the first two hours of each request. Thank you.

From: Mcguinn, Lauren S. (RMD) (FBI)

Mr. Lipton,

I will let the analyst know that you do not agree to the search fees.
