This is a request under the Freedom of Information Act. I hereby request papers authored, presentations given, and emails sent and received, by Corey Hilmas, former FDA official, that mention kratom, between January 1st, 2011 and December 31st, 2014.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is in response to your January 25, 2018, Freedom of Information Act (FOIA) request to the Center for Food Safety and Applied Nutrition (CFSAN) requesting papers authored, presentations given and emails (date range 01/01/2011 thru 12/31/2014) sent and received by former FDA/CFSAN official Corey Hilmas that mention Kratom.

Attached are documents responsive to your request. They are being released in part. After a thorough review of the responsive records, we have determined that portions of the documents are exempt from disclosure under exemptions (b)(4)and (b)(5) of the FOIA 5 U.S.C. ยง 552, as delineated below.

Exemption (b)(4) permits the withholding of commercial or financial information that was obtained from a person outside the government and that is privileged or confidential. The withholding of such information is permitted if disclosure is likely to cause substantial competitive harm to the person who submitted the information.

Exemption (b)(5) permits the withholding of inter-agency or intra-agency communications records which are part of the deliberative process and pre-decisional. Disclosure of such material could inhibit the open and candid expression of opinions and diminish the quality of the decision-making process.

CFSAN consider your request closed. You have the right to appeal this determination. By filing an appeal, you preserve your rights under FOIA and give the agency a chance to review and reconsider your request and the agency's decision.
