To Whom It May Concern:
I wanted to follow up on the following request, copied below. Please let me know when I can expect to receive a response.
Thanks for your help, and let me know if further clarification is needed.

From: Taylor Scott Amarel

Hello,

I am writing because there has been an error. I did not "withdraw" this request as the FOIA portal says. Could you please provide me an update on this request and explain why it is listed as "Request withdrawn" on https://foiaonline.regulations.gov/foia/action/public/view/request?objectId=090004d281811c24.

In fact, it appears as though the FCC immediately closed this request on the same day it was received.

From: Federal Communications Commission

Mr. Amarel,

I'm responding to the below request on behalf of the FOIA public liaison. Request 2018-424 was closed pursuant to the attached e-mail. We did not receive a response from you regarding this clarification request, and thus assumed you were no longer interested in the request. Per standard procedure, the request was marked as withdrawn. The closure date just reflects the last date we contacted you. If you wish to renew your request, you may refile it.

Dear Mr. Yates,

I respectfully dispute this. Please see the attached history of this request (or online at: https://www.muckrock.com/foi/united-states-of-america-10/collusion-ajit-pai-emails-49275/#follow-up).

The history shows that I contacted you on February 20, 2018, I received an acknowledgment on February 21, 2018. The FCC did not respond within the 20 day time period. I requested an update on March 23, 2018. I did not receive a response to my request.

Furthermore, the FOIA portal shows that the FCC closed the request on the exact day that the request was received (February 21, 2018).

I respectfully request that this request be administratively re-opened. Otherwise, I would like to submit this as a formal appeal.

The FCC can not unilaterally close a FOIA request on the day it acknowledges it, and the FCC should respond to requests within the 20 day statutory timeline.

Best,
Taylor Amarel

To be clear, this is for request #FCC-2018-000424, which stated:

"I would like to obtain all emails sent to, from, or copied to Ajit Pai, containing the non-case-sensitive key-string "collusion" from January 1, 2016 to Present Day."

The clarification email you referenced is for an entirely different FOIA request regarding "reese's" which was responded to via a separate thread. Payment is being sent for the "reese's" request, however, this request for "collusion" should not be closed.

Best,
Taylor Amarel
