To Whom It May Concern:

This is a request for a mandatory declassification review (MDR), under the terms of Executive Order 12958, as amended, of the following:

A copy of the Agency's "Aspects of Intelligence Sources and Methods of the Central Intelligence Agency That Require Protection from Unauthorized Disclosure", originally dated 12 December 1975 and number OGC 76-03333. The existence of this document has been previously disclosed and described in declassified CIA documents (attached). Further, these documents specify that the material was intended for use in litigation in regards to publication review and the Freedom of Information Act. As a result, the information itself appears to be disclosable. Further, nothing in its description would seem to match the purpose of 25X1 under which it was previously withheld, as it does not describe intelligence sources or methods, but merely the types of things which might be considered an intelligence source or method. Its disclosure would not impair the Agency's sources or methods, it would merely better enable litigants to prove that a specific piece of information is not an intelligence source or method which requires protection from disclosure.

If you regard these documents as potentially exempt from disclosure requirements, I request that you nonetheless exercise your discretion to disclose them. Please release all reasonably segregable nonexempt portions of documents.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

I am appealing the withholdings in their entirety, as a mere list of categories of information exempt from disclosure are not, in themselves, exempt from disclosure, nor are they "sources and methods" anymore than a list of types of computers is a computer. Many of the things on the list are already openly acknowledged as being used, such as informants, signal intercepts, etc. The list does not get into specifics and does not betray any specific method, and the majority of the types of methods and techniques used would not be revealed as new information.
