Dear Anthony Roberts: To retrieve the information that you may be seeking requires more specificity.  Under the FOIA, an agency is not required to conduct research.  DEA maintains several types of records and records systems (i.e., regulatory, personnel, investigative, etc.).  For example, in your letter, you are requesting “all documents mentioning Bostin Loyd,” yet you have not specified a particular DEA office that you wish searched; or the type of record that would be responsive to your request.  Be advised that DEA has 239 Domestic Offices in 23 Divisions throughout the United States, and 92 foreign offices in 69 countries, and more than 150 Headquarters Offices.  Since your description did not limit the search to a specific office or area, a vast majority of DEA offices would be tasked to conduct a search of their respective offices for any responsive records pertaining to the subject of your request.  As such, your request is overly broad and burdensome.

I was previously made aware that the FOIA officer handling my request was likely to transfer the project to another agent. As such, I would like to reiterate that the subject of the request was Bostin Loyd (deceased), and as the deceased was widely recognized by the public to be an expert in performance and/or image enhancing drugs (PEDS or PIEDS), this request is meant to encompass information referencing the deceased and those substances that fall under those categories (e.g., PEDs and PIEDs), including all anabolic steroids (aka: anabolic androgenic steroids, or “AAS”), growth hormone(aka: human Growth Hormone, or “GH,” and/or “hGH”), Insulin-like Growth Factor (aka: IGF-1, IGF-I, and/or Lr3IGF-1), Growth Hormone Releasing Peptides (GHRP) and Growth Factors and growth hormone secretagogues (including but not limited to CJC-1295, GHRP, GHRP-2, GHRP-6, MGF, MK-677/Ibutamoren, and Hexarelin), Selective Androgen Receptor Modulators (including but not limited to S1, S2, S3, S4, Ligandrol, Ostarine, Rad-140, MK-2866, YK-11, and LGD-4033), PPAR agonists (peroxisome proliferator-activated receptor agonists) such as GW 501516/Cardarine, thyroid medications (thyroxine, etc.) and beta-2 agonists (i.e., clenbuterol and albuterol).

As the subject is deceased, a release form requiring his signature is inappropriate. And again, as the subject was a recognized expert in the PEDs/PIEDs, which are DEA regulated substances under the Controlled Substance Act and Controlled Substance Analogue Enforcement Act, in addition to those acts which reference and incorporate the aforementioned acts, this FOIA request is properly and with appropriate specificity directed to the Drug Enforcement Administration. Finally, privacy concerns of the deceased regarding this request are outweighed by the fact that he was a public figure with relation to the substances specified in the request and the public’s interest in disclosure.

We are in receipt of your inquiry dated February 7, 2023, regarding the status of your pending FOIA/PA request.
We apologize for the delay in responding to your request.  DEA is among the top six of all Department of Justice components that receives the largest number of FOIA requests per year.  DEA received 1,603 requests in Fiscal Year 2022, and we have limited personnel resources to process such requests.  See Department of Justice Annual FOIA Reports available at https://www.justice.gov/oip/reports-1.  We are experiencing a backlog of approximately 1,800 requests, which has impacted our ability to process your request in a timelier manner.  Notwithstanding, your case is being processed.
Due to the large number of requests received by DEA for disclosure of records pursuant to the Acts, and due to the limited resources available to process such requests, DEA has adopted a "first-in, first-out" practice of processing all incoming requests.  This policy complies with the decision in Open America v.
