*Helpful Hints to Consider Before Filing a FOIA Request*

Have you looked at our FOIA Service
Center<http://www.cms.gov/center/freedom-of-information-act-center.html@@
?

Please explore our A-Z
Index@@http://www.cms.gov/center/freedom-of-information-act/index.html@@that
lists newly posted publicly available CMS information and datasets.

In the spirit of Open Government and transparency we have improved your
access to CMS data and information. A wealth of information about Medicare
and Medicaid including Medicare and Medicaid Provider Survey and
Certification findings can be found at
Data.Medicare.Gov@@http://data.medicare.gov/>
How to File a CMS FOIA Request

*Step 1* -In order to make a FOIA request, simply e-mail
FOIA_Request@cms.hhs.gov <FOIA_Request@cms.hhs.gov> or write to the CMS
FOIA Office or the appropriate CMS Regional Office. The addresses and fax
numbers for the CMS FOIA Office and the addresses, fax numbers, and e-mail
addresses for the CMS Regional Offices are available at the "Where to File"
link below.

*Step 2* -For the quickest possible handling, please mark both your letter
and the envelope "Freedom of Information Act Request." You should identify
the records that you seek as specifically as possible in order to increase
the likelihood that the CMS will be able to locate them. Any facts that you
can furnish about the time, place, authors, events, subjects, and other
details of the records will be helpful to us in deciding where to search
for the records that you seek.
We have provided several sample FOIA request letters that you may want to
use as a guide based on the type of information you are requesting from CMS.

*Step 3* -Please note that if you are requesting medical records for
someone other than yourself, you will need to complete a Medicare
Authorization To Disclose Personal Health Information form along with your
request. The Health Insurance Portability and Accountability Act (HIPAA)
authorization form can be found in "Downloads" as Medicare Authorization To
Disclose Personal Health Information. If the individual signing the valid
authorization is not the beneficiary, then a Power of Attorney must be
provided along with your request.

*Step 4* -If you are requesting medical records for a deceased person, you
must either A) include a copy of the document authenticating your authority
as the executor, administrator, or other person authorized to act upon the
behalf of the person for whom records are sought (such as probate court
document, or orders of administration and/or executorship); or B) if you
are not the executor of the estate, you must include a signed release
authorization from the legal representative of the deceased, as well as the
document authenticating the representative's authority (such as probate
court document, or orders of administration and/or executorship).
How We Process Your Request

When CMS receives your FOIA request it is entered into the automated
tracking system and assigned a control number. A FOIA analyst will review
your request to understand the types(s) or records you wish to obtain and
assign your request to the appropriate program office(s) to search for
responsive records. You will receive an acknowledgement letter with a
control number and instructions for checking the status of your request.

A FOIA analyst will conduct a line-by-line review of records responsive to
your request and prepare a release determination for issuance by the CMS
FOIA Officer or designee.

For more information, please see our Frequently Asked Questions download
below.
This referral officially closes out FOIA processing with the U.S. General
Services Administration.

We hope this information has been of assistance to you.

Take care

From: GSA FOIA

Dear Mr. Smathers:

This letter is in response to your Freedom of Information Act (FOIA)
referral (GSA number 264310), dated November 15, 2013, in which you
requested food service and catering services at 7500 Security Boulevard,
Baltimore Maryland that was submitted to us from HHS, Centers for Medicare
& Medicaid Services (CMMS). Specifically, you requested copies of bills
and receipts for food and or catering services at 7500 Security Boulevard,
Baltimore MD handled by CMMS in October 2013 thru November 25, 2013.

Please be advised that although the food service contract was awarded and
is administered by the U.S. General Services Administration (GSA) this
agency is not responsible for providing these services, and does not have
any bills and or receipts for food and catering services for the CMS. Any
catering services provided to CMS would have been contracted with the
vendor directly by that agency. It is recommended that this request be
directed to the attention of:

Mr. Michael Marquis, Director

Division of Freedom of Information

7500 Security Boulevard, Mail Stop N2-20-16

Baltimore, MD 21244

Phone 410-786-5352

michael.marquis@cms.hhs.gov

Since GSA does not have documentation within the scope of your request,
this does not constitute a denial. However, you can appeal the adequacy of
GSA’s search by writing within 120 days of your receipt of this letter to
the following address:

U.S. General Services Administration

Freedom of Information Act Office (H1C)

Room 7308

1800 F Street, NW

Washington, DC 20405

Your appeal must be in writing and should contain a brief statement of the
reasons why you believe GSA should have the requested information. Enclose
a copy of your initial request and this denial. Both the appeal letter and
envelope should be marked prominently, "Freedom of Information Act Appeal."

Should you have any questions related to this FOIA, please contact Dan
Cruz, Press Secretary at 202.357.9587 or by email at dan.cruz@gsa.gov.

Sincerely,

*Travis Lewis*

FOIA Appeal

To: GSA FOIA Appeals Authority AND HHS CMS FOIA Appeals Authority

Dear Appeals Authority:

This is an appeal under the Freedom of Information Act. My request has been referred from CMS to GSA and back. However, neither agency has responded to my request. The records must exist. I have requested "A copy of all bill and receipts for catering during October and November 2013 at 7500 Security Blvd. in Baltimore, Maryland."

Because both agencies refuse to process the request and refer the request to the other, I hereby appeal the constructive denial. Please process my request and provide the responsive records.

  • INCOMING FOIA APPEAL - GSA FOIA APPEAL 270048 - Mr. Jason Smathers - a

From: MuckRock

Please be advised that GSA has assigned tracking number 270048 to multiple requests.

Also please be advised that much like the GSA, requesters often use their own tracking methodologies. Please take care when issuing responses to address the responses to the appropriate request and requester.

For example...

The email:

requests@muckrock.com

Corresponds to the request being addressed here regarding "A copy of all bill and receipts for catering during October and November 2013 at 7500 Security Blvd. in Baltimore, Maryland."

Originally the most recent communication regarding this request was sent to another email address associated with an unrelated request:

requests@muckrock.com

Regarding: "A copy of the Fiscal Year 2009-2013 Premium Travel Reports created by your agency for submission to GSA per the Federal Travel Regulation. If you want clarification of the report I am looking for, please see this GSA website: http://www.gsa.gov/portal/category/27108"

Finally, a response mentioning GSA tracking #270048 was sent to ...

requests@muckrock.com

Regarding: "A copy of documents relating to the "Exploding Toilet" incident at the General Services Administration."

A request which has been rejected, appealed and rejected again.

Please advise as to the status and request associated with GSA tracking #270048.

Thank you for your time and commitment to keeping the government open.

From: Jason Smathers

User Flag: GSA called and indicated the original request was given FOIA number 264310 and the appeal is tracked under 270048. They said the appeal will indicate no records still, and suggested that the request be sent to HHS' main FOIA office indicating that CMS should be able to process the request and GSA is unable.
