Pursuant to Alabama's Public Records Law, I hereby request the following records:

A copy of all maintenance records and repair orders for Tuscaloosa City Schools surveillance systems (including cameras and all other components) from January 2010 through March 13, 2014. Please include the records documenting the "monthly checks" that were said to have been implemented since August 2013.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I would request your response within ten (10) business days.

Hello,
I received your fax this morning regarding an information request. I thought I had responded to this request with Mr. Purvis when we spoke via telephone on April 28, 2014. In short, here is what I told him:

After getting guidance from our attorneys, our view is that the maintenance records and repair orders you request do not fall in the definition of the a "public writing," as defined buy the Open Records Act.

Furthermore, the Open Records Act does not require the production of records for which the disclosure would be detrimental to the public's interest. The Open Meetings Act allows our school board to discuss matters in executive session pertaining to security plans, systems, safety measures, etc.

We believe that this request falls within the public interest exception to the Open Records Act. The production of these records could allow a third party to determine how to evade the surveillance system, which is detrimental to the public safety or welfare of our students and employees.

Therefore, I will not be able to provide you with the requested documents.
