Pursuant to the Missouri Sunshine Law and the Missouri Public Records Law, I hereby request the following records:

Incident report and related dashboard camera video, belt tapes, and dispatch audio, for the officer-committed shooting death of Kajieme Antoine Powell in St. Louis, Missouri, on August 19, 2014

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Hi Phil,

There is no related dashboard camera video or belt tapes relative to your request. The dispatch audio that you requested was included in the last email that you acknowledged you had received. We have submitted your Sunshine Request for the incident report.

Receipt is acknowledged of your e-mail correspondence dated September 9, 2014, requesting an incident report relative to the officer-involved shooting that occurred on August 19, 2014. Sunshine Law requests are generally processed in the order in which they are received, and there is currently a backlog of requests being handled. We would anticipate responding concerning the availability of records requested sometime during the week of September 22.

The Metropolitan Police Department will advise you of all open record material in its possession which falls within the scope of your request. You will be advised of what is available, the time required for, and cost of production once we are able to ascertain those details.

In it, you refused to provide the remainder of records I requested on August 28, 2014, and you suggested that I place a new request after completion of an investigation (one in which I am not involved, over which have no control, and to the scheduling of which I am not privy) of the homicide committed by your colleague.

Will you notify me when you become willing to provide the public records I requested (preferably by way of providing the records), or would you prefer that I schedule monthly requests for the remaining records until such time as you choose to comply with one of my requests?

In Schron Y. Jackson's e-mail of September 15, 2015, she refused to provide the remainder of records I requested on August 28, 2014, and suggested that I place a new request after completion of an investigation (one in which I am not involved, over which have no control, and to the scheduling of which I am not privy) of the homicide committed by your and her colleague. In your e-mail of October 19, you, wrote that I am "free to send in a request after the CAO completes its investigation." In fact, I am free to send in a request any and every day, before or after anyone completes any investigation.

Again: Will you notify me when you become willing to provide the public records I requested (preferably by way of providing the records), or would you prefer that I schedule monthly requests for the remaining records until such time as you choose to comply with one of my requests and do so? These are the only two ways I have thought of in which I can receive the records I requested--either you send them to me when you become willing to do so, or I keep asking you for them on a regular basis until I find that you are willing to send them. The former seems like it would involve less work on your and my part. I would prefer that you avoid wasting my and your time by simply sending the records. But if you insist, I will ask for them repeatedly instead.
