Pursuant to the Freedom of Information Act, I hereby request the following records:
Any and all records from the past year regarding your nuisance property ordinance that will be referred to as ordinance in this request but could be known (but not limited to) as Chronic Nuisance Properties as described in Chapter 10.68 of the city code.
Please provide any and all written records (including but not limited to hard-copy documents, memos, emails, word processor documents, PDF documents, PowerPoint files, images files, video files etc.) regarding the Ordinance including but not limited to:
• police calls, reports, citations, or arrests, collected by the municipality police department for the purpose of enforcing the ordinance
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Your request was forwarded to staff in the City's Police Records Unit for review and compiling of any responsive records.

This is to advise that the ordinance pertaining to Chronic Nuisance Properties under Chapter 10.68 is available by accessing your account via the My Request Center on the City’s public records request portal (GovQA).

With respect to the portion of your request which states “Please provide any and all written records (including but not limited….emails…,” clarification is needed to enable City staff to perform an adequate search for any emails you may be seeking under your request. We note that your request states “Any and all records for the past year…,” did you wish for staff to utilize the time frame of 4/10/2022 – 4/10/2023 (date of your request)? Further, we note that you request did not provide search terms under which you wish for us to perform an email search. If we were to utilize "C36289" OR "Chronic Nuisance Properties" OR Chapter 10.68 as the search terms, would this be satisfactory to you, or do you have additional search terms you would like us to utilize for the email search of our email retention system?  Please confirm if you are satisfied with the date range and search terms or if you like to make any modifications.  We will await to hear from you in this regard before proceeding with an email search.  Please note, pending clarification from you, that once emails are compiled, they will be reviewed for responsiveness to your request and for any exempt information.

Please provide the above clarification within 30 days of today’s date, or by May 20, 2023. If no such clarification is received, we will consider the email portion of your request to be concluded.
We are still in the process of reviewing remaining portions of your request and working with relevant departments to search for/compile responsive records.  If further clarification is needed, we will let you know.

At this time, we anticipate requiring approximately 35 days, or until on or about May 24, 2024, to provide an installment for your request. This is to advise that the City’s IT Department performed a search for emails in the City’s Enterprise Vault system (email storage system) based on the information provided in your April 23 clarification and utilizing the following parameters:

Time Frame: 4/22/2023 - 4/22/2024
keywords: "C36289" OR "Chronic Nuisance Properties" OR "Chapter 10.68"

The search returned approximately 1,500 emails. The emails will now need to be reviewed for responsiveness to your request and for any exempt information. You are welcome to modify the above search parameters. Please advise by May 6, 2024, if you are satisfied with the above search and results and if not, provide modified search terms under which a new search can be performed. If we have not received confirmation or clarification from you by May 6, we will proceed with reviewing the emails.

As advised under my April 19 message to you, we anticipate requiring until on or about May 24, 2024, to provide an installment for your request. We will follow up with you on or about that date regarding the status of your request. If responsive records become available in advance of this estimate, we will let you know.
