In July 2019, the Washington State Legislature amended the state Public Records Act in a way that impacts the way we are to respond to public records requests which seek documents from an employee’s personnel file.

The substance of the amended law is found at RCW 42.56.250(12):

Upon receipt of a request for information located exclusively in an employee’s personnel, payroll, supervisor, or training file, (highlighting added) the agency must provide notice to the employee, to any union representing the employee, and to the requestor.  The notice must state:

(a) The date of the request;
(b) The nature of the requested record relating to the employee;
(c) That the agency will release any information in the record which is not exempt from the disclosure requirements of this chapter at least ten days from the date the notice is made; and
(d) That the employee may seek to enjoin release of the records under RCW 42.56.540.
The remaining emails from the review performed include records from the training files for Spokane Police Department employees.  Accordingly, we will need to provide third-party notification to the individuals notifying them of your request and providing them the opportunity pursuant to the above-referenced statute, to enjoin the release of their training records.  Due to the number of employees requiring notification, we estimate an additional 30 days, or until on or about June 28, to provide a next installment.  We will follow up with you on or about that date regarding the status of your request.  If a next installment becomes available sooner, we will let you know.

Good morning Bridget:
In follow up to my October 28 correspondence to you regarding your public records request assigned tracking number P002782-071220, this is to inform you that a next and possibly final installment is now available.
The installment is comprised of a final remaining email from the review performed, which email includes an attachment pertaining to training records for a former Spokane Police Department employee.  The required notification has been made pursuant to RCW 42.56.250(12) (Employment and licensing).  However, the attachment to this remaining email also includes a list of individuals.
An appellate court decision, SEIU Healthcare 775 NW v. DSHS, 193 Wn. App. 377 (2016) holds that when a city receives a request for documents that includes a list of individuals, the city is required to determine whether the list will be used for “commercial purposes.” The case concluded that a requestor has a commercial purpose if the requestor intends to use the list for direct or indirect profit-making activity, regardless of whether the requestor intends to contact the individuals on the list or even if the individuals are personally affected by the release of the list or not. If the city has some indication that a requester intends to use a list of individuals for a commercial purpose, we are required to “investigate further” before we disclose that list.
Further, the SEIU case held that even an affirmation stating that any responsive records received for a request which include lists of individuals will not be used for commercial purposes, is not sufficient. Instead, before we can release the attachment to this email, we are required to obtain from you sufficient details as to what you intend to use the list for so that we can make an independent evaluation as to whether or not your purpose is commercial or not.

Please fill out and return the attached Commercial Purpose Declaration. A determination will then be made as to whether your stated purpose regarding the use of the list(s) of individuals contained in any compiled responsive records is sufficient to allow for the release of this information. To avoid unnecessary delay in obtaining these specific responsive records for your request, please return the completed declaration at your earliest opportunity. We will follow up with you within five business days as to the validity of the stated purpose relating to your request.  Upon receipt of the completed declaration determined to be valid, the email and its attachment will be provided to you.
The email review for your request is concluded and (with the exception of the remaining email attachment containing the list of individuals which has yet to be provided, contingent upon receiving a completed declaration from you) no additional responsive records have been located.  If you feel we have overlooked anything in responding to your request, or. if you have personal knowledge of any responsive records in the City's possession that have not yet been made available to you, please clarify your request by clearly describing what the remaining identifiable public records are, if any, that you may still be attempting to seek, and we will be glad to look into your request further.
Please provide any such clarification within 30 days of today's date, or by December 16, 2022.  Further, please complete and return the attached Commercial Purpose Declaration also by December 16.  If the requested clarification or a completed declaration determined to be valid is not received in the City Clerk's Office by that date, your request will be considered concluded and closed, and a new request will be required in this matter after December 16, 2022.
