Pursuant to RCW Ch. 42.56 (Public Records Act), I hereby request the following records:

Suspicious Activity Reports from 2012 that were designated as sharable with all Seattle Shield members. For an example of this designation, please see the first field of <http://info.publicintelligence.net/SPD-SAR.pdf>.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not. If these records exist in electronic format, I request that those electronic records be provided (not, for instance, that those electronic records be printed then digitized to create images of the printouts).

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

I believe that since this is a field in your electronic records, locating responsive records should be particularly simple, and because records responsive to this request have, by definition, been approved for disclosure to all of the approximately 100 different private entities that are members of Seattle Shield, those records should be clearly discloseable without further redaction to me.

I again suggest that you examine the sample SAR published at <http://info.publicintelligence.net/SPD-SAR.pdf>, the first field of which is "Can this information be shared with ALL Seattle Shield Members?"

I ask that in fulfillment of this request, you not create new records for me (e.g., by printing an electronic record, then digitizing it with a scanner, then packaging those images into a PDF), but that you provide electronic records electronically.

This letter is in response to your public disclosure request dated February 26, 2013 and received by the Seattle Police Department’s Public Disclosure Unit on February 26, 2013 for Suspicious Activity Reports from 2012 that were designated as sharable with all Seattle Shield members.

To clarify, the example referenced is a type of record that is no longer used by Seattle Shield. The example was actually disseminated in error, as it was not eligible or ever intended for disclosure. The current type of record that is shared with Seattle Shield Members related to 2012 reports of suspicious activity are all classified as open. However, as a courtesy, SPD is disclosing a redacted version of these reports.

Enclosed, please find these reports with redactions made throughout pursuant to the following exemption: Essential to effective law enforcement RCW 42.56.240(1).

You may file a written appeal with the Chief of Police within ten (10) business days from the date of this letter. Please include your name and address and a copy of this letter together with a brief statement identifying the basis of the appeal. Please mail or deliver your appeal to:

Dear Sir or Madam:

I appeal. It is my understanding that Seattle Shield membership is comprised of Seattle Police Department, area public utilities, the United States Department of Homeland Security, and approximately 100 private businesses. Suspicious Activity Reports already cleared for communication to scores of private entities, the vast majority of whom are not involved with any particular report, should require no redaction before their communication to other members of the public, including myself.
