From: Phil Mocek

To Whom It May Concern:

Pursuant to the Washington Public Records Act, I hereby request the following records:

A full and complete copy, including vacation days, of Jenny Durkan's calendar(s), beginning at the time of her hiring by the city for the job of mayor, including metadata. Please note that this should include all past and future events that exist in the calendar(s) at this time. I would like to receive the calendar(s) in a standard electronic calendar format such as iCal/ICS. Please do not instead render to a print-focused format such as PDF.

It is my understanding that City of Seattle staff use Microsoft Office 365 for calendaring. A helpful guide to exporting a snapshot of one's Outlook for Office 365, Outlook 2019, Outlook 2016, or Outlook 2013 calendar is available on the following web page in section "Export your calendar from Outlook": <https://support.office.com/en-us/article/Export-an-Outlook-calendar-to-Google-Calendar-662FA3BB-0794-4B18-ADD8-9968B665F4E6>. In short, open a calendar, click "save calendar," provide desired filename, indicate date range, choose amount of detail (all of it, please), click "OK," then click "Save."

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter.

I look forward to receiving your response to this request within five business days. As you know, the PRA requires you to take one of four actions within that time period: 1) provide requested records, 2) provide URL of the records as published on your website, 3) deny request and provide detailed accounting of exemptions that apply, 4) acknowledge receipt of request, inform me that you need more time in order to respond, and provide an estimate of when you will respond. If your action is #4, please save us both some time and state along with your notification which of the legally-allowed reasons for delay is applicable: 1) you need me to clarify my request; 2) you need to locate and assemble record(s) I requested (this should not apply, as these records are centrally stored and it will take mere seconds to assemble them, as described above); 3) you need to notify third persons or agencies affected by the request (should not apply, as doing so is optional, never required of a public agency, and thus does not justify delay); 4) you need to determine whether any of the records I requested, or portion(s) thereof, is exempt and thus that part or all of my request should be denied.

Sincerely,

Phil Mocek

Dear Mr. Mocek, This acknowledges receipt of your public disclosure request C033631-100918 received on October 09, 2018 regarding: Pursuant to RCW 42.56.520, this is notification that the City of Seattle has received your public disclosure request and needs additional time to respond. At this time, the City anticipates that it will be able to provide the requested records or a first installment of records on or about December 13, 2018. Sincerely,
Stacy Irwin Mayor's Office

From: Phil Mocek

Dear Sir or Madam:

Please explain the delay in providing the record I requested nearly three weeks ago.

This is a simple request for a record that you surely know to exist--it's just the mayor's calendar. Clarification of my request is not needed. The record's location is known to you. Assembling it will take seconds--as I communicated with my request, exporting a calendar from the system City of Seattle offices use will take mere seconds of time. You are under no obligation to notify any third party. Determination of whether or not the mayor's work calendar is exempt from requirements under the PRA does not take weeks. As I understand the PRA, there are no other lawful reasons for delay.

I caution you that a calendar is typically updated over time and thus that delay in response risks loss of portions of the record. Please ensure that portions of this record are not be lost prior to your completion of processing of my request. When an agency delays communication of a public employee's calendar, that employee is left with time to revise the calendar, removing entries that he or she believes the public will find unacceptable. The inexplicable delay of a trivial task combined with the generation of an opportunity to keep the public in the dark about actions of our public employees suggests a particularly bad faith failure to comply with the law.

Cordially,
Phil Mocek

We have withheld those parts of the records that are exempt under the Public Records Act under RCW 42.56.420(4) - Security - Information regarding the infrastructure and security of computer and telecommunications networks, consisting of security passwords, security access codes and programs, access codes for computer software applications, security and service recovery plans, security risk assessments and security test results to the extent that they identify specific system vulnerabilities, and other such information the release of which may increase to the confidentiality, integrity or availability of agency security, information technology infrastructure or assets. In addition, because there are redactions, I was unable to provide this installment of records to you with metadata intact. In the raw format you requested, data that would be subjected to redaction could only be deleted. If you believe you have received privileged or confidential records in error, please notify the City of Seattle immediately, through the Public Records Request Center or by email. Privileged or confidential records provided or received in error should not be reviewed, used, disseminated, distributed, or copied, and should be destroyed immediately. Thank you in advance for your cooperation. Due to the size and scope of your request, we are providing records to you in installments. We anticipate that the next installment of records will be available on or about February 22, 2019. Sincerely, Stacy Irwin Public Disclosure Advisor
Office of the Mayor

From: Phil Mocek

Dear Ms. Irwin:

I continue to await receipt of the public record I clearly identified and requested on October 19, 2018. I received no response to my request on November 6 for you to "explain the delay in providing the record I requested [then] nearly three weeks ago." I see that you created a new record and provided it to me on January 7. That new record--a collection of digitized images of printed pages--is not what I requested.

As I wrote when submitting my request, "I would like to receive the calendar(s) in a standard electronic calendar format such as iCal/ICS. Please do not instead render to a print-focused format such as PDF." If a standard format such as iCal/ICS is not feasible, then please send the record in its native electronic format.

Cordially,
Phil Mocek

Dear Mr. Mocek, My apologies; I missed your last email regarding your request. As I stated in my previous correspondence to you, I am unable to produce your documents to you with Metadata intact because there were redactions that needed to be applied. We do not have a tool that allows us to redact and provide metadata. I verified this with our IT Department. I can only create a PDF and redact from there. I am still working on your next installment of records and now estimate that I can have another installment ready for you on or around March 8, 2019. Thank you for your patience and please let me know if you have any other questions. Sincerely, Stacy Irwin

Dear sir or madam:

Please provide the records I requested, not new ones that you create for me by "printing to PDF." Much information is missing. How you wish to redact--and in fact, if you redact at all--is up to you. Technical difficulties with technology chosen by your office are your problem to solve, not the public's. I trust that qualified people carefully considered how to provide public access to public records when selecting systems for the generation, storage, and retrieval of public records your agency holds.

As a one-time courtesy, I have re-opened your request. In the future, if payment is not received within 30 days, you will need to make a new request.

We have made redactions pursuant to RCW 42.56.050, which states that the disclosure of information (1) would be highly offensive to a reasonable person and (2) is not of legitimate concern to the public.

In addition, as I have already explained to you, it is not possible for the City to provide records with metadata when there are redactions. We simply do not have the technology to support this. We are only able to provide the records in PDF format.

Dear sir or madam:

I have not received any response from you to my e-mail of October 9, 2019. In that message, I requested that you provide the records I requested, not new ones that you create for me by "printing to PDF." I noted that when you create a new record by performing said action, much information is missing from the new record. I further noted that how you wish to redact--and in fact, if you redact at all--is up to you, and that technical difficulties with technology chosen by your office are your problem to solve, not the public's.

I look forward to your prompt response, as my request is now more than 13 months old.

Dear Ms. Irwin:

I received your recent installment of records purportedly responsive to my request of October 9, 2019.

This installment, as with the previous one, does not contain any of the records I requested. It appears that you have, in effect, printed portions of those records, blacked-out some parts of those printouts, then digitized the papers and combined those images of printouts of incomplete records into a PDF file.

This obfuscation of incomplete records are of little value to the public compared to the originals. For example, one cannot use a computer to search for names or other keywords in the calendar entries or to compile statistics about how often recurring meetings occur. Further, one cannot load the electronic calendar files into one's own calendar software in order to view the entries in a calendar-like fashion, to easily jump to a particular date, etc. Imagine if the mayor herself were forced to use not her electronic calendar software, but paginated printouts of some but not all of the data in her electronic calendar files--it would be absurd.

Were you attempting to hide the activities of the mayor, this would be an effective way of doing so. These actions seem to be performed in bad faith, as they are precisely what I cautioned your agency not to do when I requested them.

The mayor's on-the-job activities are public business. Please provide records of such as requested more than one year ago.

Cordially,
Phil Mocek

--- Please respond above this line ---

Dear Mr. Mocek,
Records are now available in response to your request C033631-100918 regarding the following: To Whom It May Concern:

Pursuant to the Washington Public Records Act, I hereby request the following records:

A full and complete copy, including vacation days, of Jenny Durkan's calendar(s), beginning at the time of her hiring by the city for the job of mayor, including metadata. Please note that this should include all past and future events that exist in the calendar(s) at this time. I would like to receive the calendar(s) in a standard electronic calendar format such as iCal/ICS. Please do not instead render to a print-focused format such as PDF.

It is my understanding that City of Seattle staff use Microsoft Office 365 for calendaring. A helpful guide to exporting a snapshot of one's Outlook for Office 365, Outlook 2019, Outlook 2016, or Outlook 2013 calendar is available on the following web page in section "Export your calendar from Outlook": <https:>.

Sincerely,

Phil Mocek</https:>
