On March 16, 2021, I received your request for the following records:

“All of phone calls and phone logs made by Mr. Moreno with Pin's given to him by different facilities all calls made colllect and all calls made by with bought phone time. All of visit applicants approved and denied for Mr.Moreno. All of Mr. Moreno's video visitation logs and records. All of Mr.Moreno's write ups and disciplinary actions taken for Mr.Moreno inmate number 356013.

Request for all records in regards to inmate Jose Juan Moreno Jr inmate number 356013 I am requesting ALL of inmates phone logs and phone recording records, All records of calls made by inmate number 356013 Jose Juan Moreno's pin including all attempted calls, connected, disconnected calls. All dialed by inmate Jose Juan Moreno Jr inmate number 356013 along with All of inmates Visitors Applications approved and denied, all of inmates video visitation records and logs. Any write ups if any. Along with any Marriage Applications if any and or records of marriage if any. I am requesting for all of these in a timely manner. The requested documents will be made available to the general public, and this request is not being made for commercial purposes.”

The records responsive to this request are available on dvd. Please note that due to public health guidelines and the current state of emergency and in accordance with the recommendation from the NM Attorney General that all in-person inspections be suspended pending the state of emergency, the County cannot currently allow in-person inspection of public records. In order to accommodate your public records request, the County has made records responsive to your request available for inspection electronically. The records available electronically will be mailed to you.

Your request was forwarded to the Public Safety Department which took responsibility for gathering public records responsive to your request. The Legal Department reviewed the records to determine whether any needed to be redacted or were exempt from disclosure pursuant to the Inspection of Public Records Act. The County Attorney was responsible for the decision that the records provided should be redacted or withheld as follows:

1. Recordings of inmate phone calls have been withheld in their entirety. Additionally, phone numbers in the “other party” column of the call detail report have been redacted. Section 14-2-6(G) of the New Mexico Inspection of Public Records Act defines public records as “all documents, papers, letters, books, maps, tapes, photographs, recordings and other materials, regardless of physical form or characteristics, that are used, created, received, maintained or held by or on behalf of any public body and related to public business…” The recorded phone calls and log of dialed numbers relate to calls between private individuals and do not relate to public business. Therefore, they are not public records subject to inspection.
