To the JCLS Executive Director:

Under the Rhode Island Access to Public Records Act, §38-2-1 et seq., I am requesting an opportunity to inspect or obtain copies of the following public records:

• Active contracts with third-party vendors exceeding $50,000 for medical services that are provided to individuals in the custody of the Rhode Island Department of Corrections (RIDOC)
• Proposed contracts with third-party vendors exceeding $50,000 for medical services that are provided to individuals in the custody of the (RIDOC)
• The enacted (RIDOC) budget for fiscal year 2021
• A list of all medical institutions external to the (RIDOC) which provide inpatient and outpatient services to the individuals in DPSCS custody

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filed electronically, by e-mail attachment if available or CD-ROM if not. However, we respectfully request a waiver of these fees as we are affiliated with an educational or noncommercial scientific institution, and this request is made for a scholarly or scientific purpose and not for a commercial use.

The Rhode Island Access to Public Records Act requires a response time within seven business days. If access to the records I am requesting will take longer than this amount of time, please contact me with information about when I might expect copies or the ability to inspect the requested records.

If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law.

Dear Mr. Behne,

We are in receipt of your Public Records Request regarding: 1) Active contracts with third-party vendors exceeding $50,000 for medical services that are provided to individuals in the custody of the Rhode Island Department of Corrections (RIDOC); 2) Proposed contracts with third-party vendors exceeding $50,000 for medical services that are provided to individuals in the custody of the (RIDOC); 3) The enacted (RIDOC) budget for fiscal year 2021; and 4) A list of all medical institutions external to the (RIDOC) which provide inpatient and outpatient services to the individuals in DPSCS custody.
Your request is governed by the Access to Public Records Act contained in R.I.G.L. Chapter 38-2. In response to a request for public records, an agency is required to make available for public disclosure those records that are responsive to a request, are in the possession of the agency and are not otherwise exempted from disclosure.
Please be advised that this office does not maintain the records regarding parts 1, 2 and 4 of your request and advise you to try contacting the Department of Corrections itself.
With regards to the responsive documents that are in our possession, attached are the 2021 and 2022 fiscal-year budgets for the Department of Corrections.
In accordance with R.I.G.L. § 38-2-8, you may appeal this decision to the Executive Director of JCLS, at 82 Smith Street, Providence, RI 02903; or, you may file a complaint with the Department of the Attorney General, 150 South Main Street, Providence, Rhode Island, 02903, or the Rhode Island Superior Court of the county where the record(s) are maintained.
