From: Shawn Musgrave

To Whom It May Concern:

Pursuant to the Rhode Island Access to Public Records Act ("APRA"), I hereby request the following records:

Written procedures for access to the agency’s public records, including any
records request forms required or suggested by the agency

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

Shawn Musgrave

Dear Mr. Musgrave:

I am responding to your Access to Public Records Request which I saw when I came into work today. First, I apologize for not responding earlier. Today is the first I became aware of this request. The Department's IT Unit implemented some upgrades to the computer network back in March and it appears that during these upgrades staff who monitor this email address were removed from the access list. Although access is now restored, if you have requests in the future please feel free to send them directly to my email address. I check this address numerous times a day.

As to your request, attached are the policies which relate to your request. Given it has taken you several attempts to receive this information I am waiving the fee the Department normally charges. If you have any questions you can contact me at this email or at the number listed below.

In accordance with Rhode Island General Laws §38-2-8, you may wish to file a complaint with the Department of the Attorney General, 150 South Main Street, Providence, RI, 02903, or the Rhode Island Superior Court of Providence County. Additional information concerning the Access to Public Records Act is available through the Attorney General's website at www.riag.ri.gov.

Sincerely,

s/s Kathy Kelly
