Pursuant to the Rhode Island Access to Public Records Act ("APRA"), I hereby request the following records:

A spreadsheet, database or other summary of all employees who received payout upon leaving the agency in 2013, as well as what those payouts were.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Your Access to Public Records Act (“APRA”) request dated June 9, 2014, has been forwarded to me for response. Specifically, you seek:

“[a] spreadsheet, database or other summary of all employees who received payout upon leaving the agency in 2013, as well as what those payouts were.”

After review of this Department’s records, it has been determined that this Department does possess records responsive to your request. Attached to this correspondence is a .pdf consisting of six (6) pages. Certain information has been redacted since it is not responsive to your request. See also Direct Action for Rights and Equality v. Gannon, 713 A.2d 218 (R.I. 1998).

Pursuant to R.I. Gen. Laws § 38-2-4(a), this Department is authorized to charge fifteen cents ($.15) per page for documents copyable on common business or legal size paper. Please forward a check or money order made payable to the “State of Rhode Island” in the amount of .90 cents.

The search and retrieval consisted of twenty-five (25) minutes. See R.I. Gen. Laws § 38-2-4(b).

This decision can be appealed pursuant to R.I. Gen. Laws § 38-2-8.
