Pursuant to the Colorado Open Records Act, I hereby request the following records:

Metadata for email communications sent or received, including being CCed or BBCed, between the dates of 1/1/2022 and 9/6/2023 which include Police Chief Chris Noeller and at least one of the following keywords: "ShotSpotter", "Shot Spotter", "SoundThinking", "RTCC", "Real Time Crime Center" and/or "SST."

The specific metadata data points I'm interested in are: to address(es), from address, cc address(es), bcc address(es), sent date/time, received date/time, subject line, and if the email has an attachment. This request does not seek the contents of the emails themselves, and only the specified email metadata. Please provide me the records in an Excel format.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

"On September 12, the City received a CORA request from you pursuant to the Colorado Open Records Act (“CORA”). It states:

This request does not seek the contents of the emails themselves, and only the specified email metadata. Please provide me the records in an Excel format.

The City of Pueblo stores email metadata as part of the underlying record, not independently in a separate format. Therefore, no records exist that are responsive to your request.

You may request the emails containing your desired criteria and keyword terms. Assembling such public records will require a physical and electronic search. The search for, review and redaction of public records in compliance with C.R.S. § 24-72-204 and Ritter v. Jones, 207 P.3d 954, 957 (Colo. App. 2009) will be performed to respond to your request.

The City has performed a preliminary search and has identified approximately 887 records that may be responsive to your request.

Therefore, pursuant to Pueblo City Council Resolution 14455 and C.R.S. §24-72-205, the City of Pueblo estimates that the time required for providing these records to be approximately 29.5 (twenty-nine and a half) hours, calculated using a guideline of 2 minutes per item to perform the necessary research, legal review, and redaction of items eligible for disclosure. Time spent responding to CORA requests is billed at the rate of $33.50 per hour. The City does not charge for the first hour of work when responding to CORA requests. Therefore, the anticipated cost and requested deposit for this search is $954.75, calculated at $33.50 per hour for 28.5 hours of billable time. This estimate anticipates that digital copies will be provided. If you would like paper copies, there will be an additional charge.

If the City’s ultimate costs are less than the amounts estimated, any overpayment will be refunded to you. Conversely, you will be billed for the City’s actual costs if they exceed the initial deposit amounts given. Please make your check payable to the City of Pueblo and send it to the Clerk’s office, or you may contact the Clerk’s office directly to arrange for other payment. The City will not begin preparing materials until the requested deposit is received.

If you would like less costly options, you may want to revise the scope of your request by limiting the subject matter/topic of the message, reducing the timeframe, specifically identifying by name the sending or receiving party(ies) to the message, or otherwise placing further restrictions on the criteria used to search for the records, etc. The broadly stated request and large number of records responsive to your request results in a finding of extenuating circumstances because the City is unable to prepare the records for release within such a short time. Therefore, the City must extend the three-day deadline for response to seven additional working days as permitted by C.R.S. § 24-72-203(3)(b).
