To Whom It May Concern:

Pursuant to the Pennsylvania Right to Know Act, I hereby request the following records:

1) Copies of all invoices submitted to the department by ID.me for identity verification services from the date the department's identity verification contract with ID.me began until the present. These invoices include the number of successful identity verifications completed by ID.me during the designated invoice period. However, If the Department separately maintains data on successful ID.me verifications during the duration of the contract I will accept the data in lieu of the invoices.

2) Aggregate monthly data, from Jan. 1, 2019 until the date this request is processed, documenting the number of unemployment insurance applications received, approved, and denied. Please note, I am not asking for any personally identifiable information.

3) All department contracts, memorandums of understanding, statements of work, and contract performance evaluations regarding ID.me.

I ask that all fees be waived as intend to use the requested records to further public understanding of public agencies and not for any commercial purpose. In the event you choose to impose fees, I request a detailed breakdown of the fees, including the hourly wage of each employee involved and an explanation justifying the employee hours required to fulfill the request.

Should you choose to reject this request or redact portions of responsive documents, I ask that you provide a detailed breakdown of the statutory exemptions and associated case law underlying your decision to withhold each/any portions from public review.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

What records were withheld pursuant to the trade secrets exemption? Are you saying the ID.me invoices contain trade secrets?

Todd,

ID.me has claimed that the invoices contain trade secrets and/or confidential proprietary information. However, the invoices do not include information relating to the number of successful identity verifications completed by ID.me during the designated invoice period.

Hi Wendy,

Thank you very much for the clarification.

I understand that ID.me has "claimed" that the invoices contain trade secrets, but does the department agree with that determination? I've seen many ID.me invoices from other states and they're pretty bare-bones documents. They certainly don't contain trade secrets.

If you intend to withhold the invoices, I ask that you provide a full legal justification for doing so. The Right to Know Law requires that an agency issuing a denial provide "The specific reasons for the denial, including a citation of supporting legal authority."

Attached is the redacted ID.me invoice. The information redacted includes an FEIN, which is made confidential by Section 6103(a) of the Internal Revenue Code, 26 U.S.C. Section 6103(a), and electronic payment information which is exempt from disclosure pursuant to RTKL Section 708(b)(6)(i)(A), 65 P.S. Section 67.708(b)(6)(i)(A).
