From: Phil Mocek

To Whom It May Concern:

Pursuant to RCW Ch. 42.56 (Public Records Act), I hereby request the following records:

Public disclosure legal log (log of public records requests received by your agency, along with classification, time dedicated to processing each request, current status, final resolution, etc.)

If this record exists in electronic form, I request that you not create a new record for me (e.g., by printing your electronic record then scanning it to make a series of images of the printed data) but provide the electronic record itself in its native format.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Sincerely,

Phil Mocek

Mr. Mocek:

I received your public records request on July 14, 2014, in which you requested the following records:

Public disclosure legal log (log of public records requests received by your agency, along with classification, time dedicated to processing each request, current status, final resolution, etc.)

The City anticipates it will need until August 15, 2014, to respond to your request; however the response could potentially take additional time.

If additional time is necessary or if the documents can be made available in less time, I will certainly let you know. As provided in RCW 42.56.520, this time is needed to locate and assemble the information and review the documents to determine if they are:

- open for disclosure, or;
- the document(s) contain exempt material requiring redaction (i.e., the exempt material has been deleted and the rest of the record is disclosed), or;
- the document(s) are exempt from disclosure; and,
- to provide a statement of the specific exemption authorizing the withholding of all or part of the record;
- or if we need to notify a third person or agencies affected by your request.

As I progress with your request, I may be in contact with you to request further clarification of the records you seek. If you have any questions concerning your request, please feel free to contact me.

From: Phil Mocek

Ms. Stull:

My assumption, based on experience requesting and receiving other agencies' public disclosure legal logs, is that this is a single record, such as an electronic spreadsheet. I requested the entire record. Assuming it exists, I would expect it to contain entries related to all public records requests for which entries have not been purged in accordance with your agency's data retention policy.

Cordially,
Phil Mocek
