Pursuant to the North Dakota Open Records Law, I hereby request the following records:

I’m requesting video and photos collected by law enforcement through the use of FLIR/Infrared/IR/thermal/nightvision, during the Dakota Access Pipeline protests which occurred between September 1st, 2016, and March 1st, 2017 in North Dakota.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days.

Good afternoon Mr. Neef.
I have obtained preliminary information related to your request. Our IT department estimates hundreds of hours of video exist which meet your request. Duplication of this video and the charges associated with it will be billed on an hour per hour scale (this does not include redaction obligations). It will take one employee hour to duplicate one video hour.

A conservative estimate to fulfill your request is $15,000. The final cost will likely be much greater when we factor in potential administrative or IT related functions involved in such an endeavor.

I’ll await your response prior to any further action.

There are a lot of moving parts to your request, some of which I wasn’t aware of. I’ve checked all of the boxes and have verified the request below can be met. IT has means of locating the files without significant time involved and redaction won’t be applicable as there is no audio. The total time invested will be less than five hours. It will be approximately $25 per hour. Do you wish for us to send you the videos based upon this information?

Can you please tell me who would have that FLIR footage from October 27th? I presumed NDHP would have many hours of footage from that date given that on October 27th, 2016, NDHP participated in an extremely high profile operation which lasted close to 24 hours, during which surveillance aircraft were airborne.
