To Whom It May Concern:

Pursuant to the Rhode Island Access to Public Records Act ("APRA"), I hereby request the following records:

A copy of the police log for the past week (7 days).

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

Shawn Musgrave

Hi Shawn,

Last time you inquired about our access to public records procedure, I sent you a link. Our form is online at cityofnewport.com. You take a chance by emailing an individual for a request as I happen to be on vacation. So it would be more appropriate to follow the procedure. I am copying my assistant so your request will be fulfilled in a timely manner.
Thanks,
Lt Dvorak

Hi Shawn

My supervisor asked that I email you regarding your request for a
"police log" for week of 05/01/14 - 05/07/14. Please note we do not have
a generic "police log". If you could respond with a bit more detail as
to what your are looking for, I will be better able to assist you.
Thank-you,

Deidre Sharp

Hello,

I am looking for the dispatch log over the indicated time period. Does this clarify adequately? If not, I'd be happy to give you a call.

Thank you!

From: George, Gwen

I have received your request for the Newport Police dispatch log from
May 1st thru 7th. This request will be time consuming and costly . Each
incident will have to be opened and it will have to be determined what
is public record and information redacted. Under the Access to Public
Records Act the cost will be .15 per page and there will be a $15.00 per
hour cost after the first half hour. If you would like us to proceed
with your request please let me know. There were over 500 entries and
each will have to be looked at individually. 38.2.4 (a)(b)

Hello,

It is my understanding of APRA that government agencies must release documents in requested format unless doing so would be unduly burdensome. As a number of departments have released digital copies of their dispatch logs, I do not think it is necessarily the case that doing so is burdensome, depending on the software your department uses.

Furthermore, several departments have released the requested dispatch log without any review or redaction whatsoever, and at no charge.

Please confirm whether you are able to release the requested logs in digital form, as requested, and provide a cost estimate if you determine that fees will be charged.

Best,
Shawn
