From: New York City Police Department

The New York City Police Department (NYPD) has denied your FOIL request FOIL-2023-056-02469 for the following reasons: (https://a860-openrecords.nyc.gov/request/view/FOIL-2023-056-02469)
In regard to the document(s) which you requested, I must deny access to these records on the basis of Public Officers Law Section 87(2)(e)(iv) as such information, if disclosed, would reveal non-routine techniques and procedures.
Please visit FOIL-2023-056-02469 to view additional information and take any necessary action. You may appeal the decision to deny access to material that was redacted in part or withheld in entirety by contacting the agency's FOIL Appeals Officer: (https://a860-openrecords.nyc.gov/request/view/FOIL-2023-056-02469) foilappeals@nypd.org within 30 days. From: Ben Welsh

I am writing to appeal this response. I encourage you to reconsider it administratively. If not, I ask that a formal appeal inquiry be opened.

The records I've requested are, in my view, routine procedures that also contain "instructions to staff that affect the public."

The section of the law you cite says clearly that such records should be released, at least in large part.

These records are routine because:
* The production materials have been copied and applied to thousands and thousands of NYPD materials, including websites, print records, buildings and cars. The designs are ubiquitous in our city and their new application happens every day. Reproductions are made with only rare variations from the mold. Therefore, I believe they qualify as routine.
* Because the use of these materials is so widespread in public places, I argue that these materials are clearly instructions that affect the public. We all see them virtually every day.

Please release these records.

Thank you for the prompt response. I would like to narrow my request strictly to " any style guides, design guides and other documentation or memos that provide guidance how to design materials on behalf of NYPD." These reference materials should not include any materials capable or reuse or reproduction, which is the issue raised in your appeal denial.

Can that be done?
