Dear Ms. Nanco:

We are in receipt of your public records request received 4-5-21. Pursuant to 14-2-8(D) of the IPRA, you will be provided with this agency's response, including whether the Department has any objections (based on exemptions provided in the IPRA), within 15 days of receipt of your request, on or before 4-20-21. Please note the tracking number assigned to your request. You will need to refer to this number in any follow-ups you may have.

Pursuant to Governor Lujan Grisham's declaration of a state of emergency, Public Health Orders issued by the Health Department, and subsequent orders, all in-person in inspection of public records during the pendency of the state of emergency is suspended. The Corrections Department will make every effort to comply with the mandates of IPRA by producing records electronically where possible by the deadline above. If circumstances arise where records are not available for production in the normal timeframes mandated by IPRA due to staff being out of the office or the records requested too voluminous to deliver electronically, your request may be determined to be excessively burdensome to respond to during the state of emergency, and response times extended to after the state of emergency ends. The current emergency order for telework is still in effect. A subsequent order by the Governor may extend that deadline. The Department will work to gather the documents responsive to your request as best it can during the interim, in an effort to minimize delays as much as public health measures and employee health permit.

If your request seeks medical or mental health records of an inmate, please be advised that such records are not public records subject to inspection or copying via IPRA Section 14-2-1(A) NMSA. Requests for such records should be directed to Melody.Bernal@state.nm.us<mailto:Melody.Bernal@state.nm.us> with a copy sent to AliceM.Pino@state.nm.us<mailto:AliceM.Pino@state.nm.us>

Pursuant to 14-2-10 of the IPRA if the Department determines that your request is excessively burdensome or broad, you will be notified within the timeframe noted above and provided with an estimate of how much additional time will be needed to comply with your request.

Please be advised that any attorney client or confidential information otherwise protected by law will not be subject to inspection.

Should you request copies of records, you will be required to pay the fees imposed by the New Mexico Department of Corrections, pursuant to provisions of the Inspection of Public Records Act Section 14-2-1 through 14-2-16, NMSA 1978, of $.25 per page for 11 x 17 inches or smaller.

no problem with paying any fees thank you for your response

From: New Mexico Corrections Department

Dear Ms. Nanco:

We previously responded to your IPRA request on 11/21/19 under no. 19-586, providing you with all visitor logs and phone calls. We would prefer not to duplicate this request. Based on this, we are closing your recent IPRA request 21-256 as a duplicate to the extent that disciplines for Mr. Moreno have already been sent to you.

Attached is the dropbox link for all calls from 11-21-19 to present. Also included in the link is the call spreadsheet and the redacted visitor log for Mr. Moreno.

In all documents produced, personal identifying information has been redacted including months and days of birth, Social Security numbers, tax identification numbers, driver's license numbers, and financial account numbers of relatives pursuant to Sections 14-2-1.1 and 14-2-6(E), NMSA 1978. Personal or home addresses and phone numbers have also been redacted within the provided documents pursuant to Section 14-2-6(G) (Record must relate to public business to be defined as a public record) and the Attorney General's Inspection of Public Records Act Compliance Guide, Eighth Edition, pages 25-27 (Agency can deny a request for personal contact information because the record does not relate to public business, as it does not reveal anything about the official acts of the employees or the operations or activities of the agency).

The Department has responded to your request as it understands it, and it is now considered closed.
