Pursuant to the Tennessee Public Records Act, I hereby request the following records:

Any document(s) sufficient to show the budget for, costs of, and/or number of hours worked on the research, investigation, preparation, or production of the "Special Report: Sex Week at the University of Tennessee-Knoxville," available at https://comptroller.tn.gov/content/dam/cot/orea/documents/orea-reports-2019/SexWeek_FullReport.pdf.

2. Any document(s) consisting of or reflecting any communication with any person not employed by the Tennessee Comptroller of the Treasury, sent or received before February 20, 2019, concerning Sex Week or the Comptroller's Special Report.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I apologize for the delay in response. Please see the boldfaced language below.

1. Your request for public records regarding a budget for and number of hours worked on the Report is denied on the basis we have no such responsive records. As to public records regarding the costs of the Report, we found several emails consistently stating:

Report Printing expense $6,716.46

Travel to Knoxville for Research $802.43

No documentation was attached to the emails. If you wish to request copies of the public records either or those emails or of the actual printing invoice/payment or travel reimbursement, please see the response below.

2. Any document(s) consisting of or reflecting any communication with any person not employed by the Tennessee Comptroller of the Treasury, sent or received before February 20, 2019, concerning Sex Week or the Comptroller's Special Report.
Based on the volume of public records responsive to this request, much of which was documentation provided by the higher education institutions, we estimate it will take over 31 hours to produce the records to be delivered on a storage device (our preference is to use a flashdrive). Pursuant to our Public Records Policy, you will not be charged for one hour of the highest wage(s). There are several exceptions to the TPRA that may apply to these records (such as Tenn. Code Ann. Section 10-7-504(f)) and redaction may be required. Additionally, Tenn. Code Ann. Section 4-3-308(b) provides that "[t]he Office of Research and Education Accountability shall maintain inviolate any privileged or confidential information so acquired [from any agency of this state] and any record or writing so defined by law." This requires us to confirm exceptions that may not otherwise apply to records held by our office.

The cost of the flashdrive is $15. The estimated total cost is $1,336.00 This not include cost of mailing to your home if you choose not to pick up the device in person; however, we believe this estimate is the most the cost would be. As this request involves a large volume of records and a large dollar estimate, we are willing to accept an initial payment of $900 and will request payment of the remaining amount based on actual. Please send a check made payable to the Office of the Comptroller of the Treasury.

Upon receipt and acceptance of your check, we will begin work on your request and, at this time, anticipate it will take about four full work weeks to complete.
