To whom it may concern:

Under the North Dakota Open Records Statute, N.D.C.C. §44-04-18 et seq., I am requesting copies of the following public records:

* Documents showing the balance of any funds used by the Morton County Sheriff's Department obtained through civil asset forfeiture.
* Expense reports from 2010 onward showing any expenses paid for by the Morton County Sheriff's Department, in full or in part, by funds obtained through civil asset forfeiture.
* A list of all items seized through civil asset forfeiture and retained for use by the Morton County Sheriff's Department since 2010.

I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

If there are any fees for searching or copying these records, please inform me if the cost will exceed $100. However, I would also like to request a waiver of all fees in that the disclosure of the requested information is in the public interest and will contribute significantly to the public’s understanding of how law enforcement agencies involved in North Dakota are equipped and funded. I am a freelance journalist and these documents are part of news gathering for stories on North Dakota law enforcement agencies. There is significant public interest in North Dakota law enforcement agencies due to their involvement in policing communities where protests over the Dakota Access Pipeline have occurred. This information is not being sought for commercial purposes.

I would request a prompt response to this request within ten (10) business days. If you expect a significant delay in responding to or in fulfilling this request, please contact me with information about when I might expect copies or the ability to inspect the requested records.

If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law.
