I am a member of the news media and request classification as such. I have previously written about the government and its activities, with some reaching over 100,000 readers in outlets such as Gizmodo, MuckRock, Motherboard, Property of the People, Unicorn Riot, and The Outline, among others. As such, as I have a reasonable expectation of publication and my editorial and writing skills are well established. In addition, I discuss and comment on the files online and make them available through non-profits such as the library Internet Archive and the journalist non-profit MuckRock, disseminating them to a large audience. While my research is not limited to this, a great deal of it, including this, focuses on the activities and attitudes of the government itself. As such, it is not necessary for me to demonstrate the relevance of this particular subject in advance.

As my primary purpose is to inform about government activities by reporting on it and making the raw data available, I request that fees be waived.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I have been asked to assist the Department in responding to your request. First, I want to apologize for the delay in our response. Enclosed are the records pertaining to commissary records.

I will attempt to address the other categories of records you have requested in the order you listed them.

The Department does not charge co-pays for medical services, therefore there are no responsive documents for this category.

The Department also does not have a record of the number of offenders who report to the infirmary or the number of offenders who report respiratory or breathing issues, flu-like or pneumonia-like symptoms. Nor does the Department keep a record of how many offenders are referred for outside medical care.

The Department has not ordered COVID-19 tests, therefore, there are no responsive records.

Transfers of offenders in and out of prisons are closed records pursuant to section 217.075.1(3) RSMo.

We are not the custodian of records for BOP prisoners, therefore you will need to contact that agency for those records.

Regarding the category you describe as records describing the number of offenders released each month and the monthly prison populations from September 2019 to present, this request is not reasonably specific enough for the Department to identify the records you are requesting. If you can provide additional clarification, we may be able to assist.

The Department does not have compassionate releases, and therefore there are no responsive records for this category.

The records you are seeking pertaining to medications for offenders, medications are provided by an outside provider so the Department has no records responsive to that request.
