Pursuant to the Minnesota Government Data Practices Act, I hereby request the following records:
All documents and written communication including, and relating to, the merger review of Sanford Health and Fairview Health Services
All documents and written communication between the Office of the Attorney General of Minnesota and the Federal Trade Commission regarding the merger between Sanford Health and Fairview Health Services. As the merger was proposed in 2022, the date range for this record search should be Oct. 1, 2022 to June 26, 2023.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Good afternoon, Ms. Liss,
Thank you for your email, in which you requested that the Minnesota Attorney General’s Office (“AGO”) provide you copies of all documents and communications (including communications between the AGO and FTC) regarding the proposed merger between Sanford Health and Fairview Health Services between October 1, 2022, and June 26, 2023.
Your request as submitted will likely yield a high volume of responsive data, which will in turn require significant staff time to review and classify. Accordingly, and in order to expedite processing, you may wish to narrow or otherwise modify the scope of your request by providing specific keywords, a narrower date range, or specific divisions of this Office to which your request pertains. Furthermore, please note that much of the AGO’s data is likely classified as not public under various provisions of the Minnesota Government Data Practices Act. E.g., Minn. Stat. § 13.39, subd. 2(a) (active civil investigative data are confidential or protected nonpublic); Minn. Stat. § 13.65, subd. 1(c) (consumer complaint data are private); Minn. Stat. § 13.393 (data held by an attorney acting in a professional capacity for a government entity are exempt from disclosure). Note that this is not a denial of any portion of your request, and you are not required to modify your request if you do not want to.
At your convenience, could you please respond and indicate whether you: (1) would like the AGO to process your request as submitted; or (2) would like to narrow or otherwise modify your request? The Office appreciates your time and attention in the matter and looks forward to your response.
