Pursuant to the Minnesota Government Data Practices Act, I hereby request the following records:

We are aware that air quality management agencies sometimes conduct "exceptional event demonstrations," which are analyses to demonstrate that emissions from potential exceptional events caused an exceedance of one or more NAAQS. These demonstrations are then submitted to the Regional EPA office in order to request that the office exclude the air quality monitoring data from use in certain regulatory determinations.

Concerning services related to these exceptional event analyses, we request:
1. Any and all executed contracts, memorandums of understanding (MOUs), or other equivalent agreements that are currently active, or have been active within the last five years;
2. Any addenda, amendments, attachments, exhibits, materials, and schedules;
3. Any and all correspondence, between the relevant air quality agency and the contracting individual, corporation, or other entity, related to the implementation of these agreements.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you for submitting your request for information from the Minnesota Pollution Control Agency. We have assigned a file manager to start gathering your information and work on your request.

Please note that the MPCA has revised its fee structure effective March 23, 2021. Staff time spent to fulfill requests will be billed at a flat rate of $25.70 per hour for requests that require more than three hours to complete. The remainder of searches will be conducted free of charge.

We expect this to affect a small percentage of requests. A file manager will notify you if your request is expected to accrue fees and provide an opportunity to narrow the scope of your request. We have received numerous inquiries, recently the above two. We were told by another reporter the information was no longer needed yet these inquiries persist. We have made several attempts to make contact to clarify but no responses and only get more inquiries. At this stage we are at a loss of what to do.

Hi, Lenny.

I'm so sorry there's confusion. The goal of this email is to end it.

Neither Dillon Bergin nor I have told anyone that information or a response is not necessary. Our known history with this request is that it was submitted May 23rd, responded to by Faith Krogstad, who said it was unacceptable as it was, so we re-submitted electronically in June via PDF and a colleague at Muckrock named Miranda Carruth.

We were notified in June that you were our case manager, and then we received a communication on July 14th that "Research for your information request has been completed. You will receive a follow up email regarding how to access the information, or an explanation of why the information is unavailable." So we thought everything was proceeding normally, and had no reason to suspect otherwise.

I am happy to call you to clarify what is happening. I am reachable at 415 377 1760 as well.

With all the confusion, I'm sorry this took so long for a response.

I received the below response from staff:

My group actually has seen this request in the past. The response is that we have not conducted an "exceptional event demonstration" and do not have any of the information requested. These demonstrations are only done when a state has data that indicates non-attainment which may be due to an exceptional event. Minnesota has not been in that situation yet, so we have not done a demonstration.

I now consider this request as closed. Any further questions, please let me know.
