This is in response to the UIPA request dated June 17, 2016. Please refer to the attached Notice to Requester which indicates that the Department of the Attorney General will need additional information from Muckrock in order to process the request for information.

This is also to inform you that we are not in possession of all of the information that is in the request. I am referring you to the Honolulu, Maui, Hawaii, and Kauai police departments for information pertaining to local policies, procedures, directives, memorandums, and any other guiding materials regarding matters pertaining to:

* the public seeking firearm acquisition, licensure, use, and transfer, etc;
* revocations of firearms permits and licenses;
* the sale and purchase of firearms at gun shows; and
* data, statistics, or reports on the revocation of firearms permits and licenses.

The Department of the Attorney General processes applications for concealed carry licenses to retired law enforcement officers pursuant to the Law Enforcement Officers Safety Act (LEOSA). The policies and procedures relating to the issuance of LEOSA licenses can be found at the following public website: http://ag.hawaii.gov/cjd/law-enforcement-index-page/

The Department of the Attorney General publishes firearm permitting and registration statistics for the State of Hawaii and its counties annually (2000-2015) in our Firearm Registrations in Hawaii reports. Statistics on the weapons used in violent crimes are published annually (1996-2014) in our Crime in Hawaii Uniform Crime Reports. Any and all policies, procedures, directives, memorandums, and any other guiding materials regarding matters pertaining to firearm acquisition, licensure, use, and transfer, including, but not limited to, the following:
• policies and procedures on the issuance of firearms permits and licenses. (Please note that this point is not a request for the identities of individual permit or license holders, but, rather, is a request for governmental policies and parameters regarding the process and regulations by which one may obtain either a permit or a license. If separate strictures exist for each, provision of both would be greatly appreciated.)
• policies and procedures on the revocation of firearms permits and licenses.
• any and all available policies and procedures regarding local firearms policies. Please provide all such materials that alter or supplement departmental procedures.
• policies and procedures regarding the sale and purchase of firearms. Please include all materials regarding the appropriate qualifications for the sale or purchase of firearms. Please include materials for particular venues, if available, including but not limited to the sale and purchase of firearms at gun shows.
• policies and procedures regarding the transfer, either out-of-state or between individuals, of firearms.
Please include all available segregable data.
Please also provide all available data, statistics, or reports regarding matters pertaining to gun acquisition, licensure, use, and transfer, including, but not limited to, the following:
• the issuance of firearms permits and licenses.
• the revocation of firearms permits and licenses.
• incidents involving the use of a firearm.
• the sale and purchase of firearms.
• the transfer, either out-of-state or between individuals, of firearms.
If various policies or reports exist dependent on the type of firearm, provision of all applicable materials would be greatly appreciated. Should they be voluminous, provision of materials on rolling basis would be greatly appreciated.
Should your agency believe that any additional policies, procedures, reports or other analysis pertaining to firearm acquisition, licensure, use, transfer, deaths, incidents, or any related issues may reside with another agency or agencies, indication of such agencies would be greatly appreciated.
Please notify us if further clarification is necessary.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

My office received your UIPA request today, a short while ago. Please forward the original "sent" email that was submitted to CRSMAIL@MPD.net, so that we may verify the original request date and establish a more specific production timeline on your request as required by HRS §92F and HAR §2-71-13.

Our agency will be applying the $60 public interest waiver to fees incurred, however, all other fees and costs are collectable and will be itemized on our agency's forthcoming Response to Requestor prior to processing.

As no response was received regarding our 07/22/16 inquiry, we are again attempting, in good faith, to obtain a clarification on your request utilizing the "preferred" email address noted in your original request. We understand that your original request was addressed to the State Attorney General's Office who offered a response and instructed you to further inquire with MPD regarding your unanswered questions.

Below, the copy of your original June 17th (addressed to the AG's Office) request was forwarded to The Maui Police Department (MPD) on 07/17/2016 , but is dated it 07/18/16). Also, the first line in the request is dated July 1st. This initially caused confusion as to what the actual "received" date by MPD should be. This date is important in order to schedule response deadlines in our very busy Records Unit and remain compliant with UIPA law. MPD will recognize 07/18/2016 as our "received" date, since 07/17/16 was not a business day.

Also, as we did not receive a reply to my email of 07/22/2016, I ask for a direct email reply in order to confirm that the email address "requests@muckrock.com" is the appropriate method of contact throughout the processing of this request.

Finally, MPD also requests additional search parameter clarification on the items highlighted in yellow and noted in red below. If no response to this email is received in digital or other form by August 15, 2016, (MPD) will consider this request abandoned in accordance with Hawaii Administrative Rules (HAR §2-71-16).
