Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

* All policies, procedures, and training documents regarding marijuana laws that will be used once the marijuana legalization ballot question goes into effect

* The most recent policies, procedures, and training documents regarding marijuana laws in use prior to the marijuana legalization ballot question going into effect

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

* The Department may send you a good faith estimate for the cost of responding to your inquiry because, pursuant to the Massachusetts Public Records Law, a records custodian may charge and recover a fee for the time he or she spends searching for and segregating responsive material.

The Massachusetts Department of State Police (“Department”) has received and reviewed your request seeking Department records related to (1) the most recent policies, procedures and training documents regarding marijuana laws in use prior to the marijuana legalization ballot question going into effect as well as (2) all policies, procedures and training documents regarding marijuana laws that will be used once marijuana legalization ballot questions goes into effect.

The Department has identified responsive records. Regarding the first part of your request, attached please find MA Department of State Police General Orders INV-11 (Property and Contraband), INV-13 (Asset Forfeiture) and Superintendent’s Memo 08-SM-13 (Civil Disposition for Possession of One Ounce or Less of Marijuana) as well as MA Department of State Police Academy Lesson Plan for 94C MA General Laws.

As to the second part of your request, attached please find MA Department of State Police Superintendent’s Memo 16-SM-10 (Enforcing State Laws Regarding Marijuana).
