From: Andrew Quemere

To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I making a public records request.

I am looking for logs, spreadsheets, or similar documents that track the administrative process for injured workers (Conciliations, Conferences, Hearings, Review Board). Such documents might contain information such as what date a claim was opened, when steps in the administrative process are scheduled, when a claim was closed, what the result of the claim was, etc. To be clear, this request does not seek any private medical information.

If such records exist and are in an easily reproducible, electronic format, I would like all that are currently on file. If they are no in an easily reproducible format, I would like all such documents for January 1, 2012 to the present.

If no such records exist, I would be extremely appreciative if someone could be made available to speak with me about alternative records I might be able to request to obtain this information.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Sincerely,
Andrew Quemere

Mr. Taupier,

Thank you so much for your response. How were you able to generate these numbers? Were they prepared specifically for my request, or does the DIA prepare quarterly or annual reports that I could request copies of?

I hope you have a wonderful Thanksgiving.

Best regards,
Andrew Quemere

From: Taupier, Bill (DIA)

Mr. Quemere,

Those stats are derived from general information on each stage of the process. The known quantities are the numbers of cases scheduled at each stage and the numbers of cases resolved via their disposition. These are aggregate numbers. As for existing reports, I would encourage you to look at the Annual Reports of the Workers’ Compensation Advisory Council for additional stats. All of these reports can be found online at the following address:

http://www.mass.gov/lwd/workers-compensation/wcac-pubs/annual-reports/

The latest version is the FY 2015 report. The FY 2016 is due to be published in early 2017.
Best regards,

Bill Taupier
