Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, ยง10, I hereby request the following records:

All communications, memos, emails, and text messages between William D. Delahunt and members of the Massachusetts Department of Public Health dating back two years from the date that this request is processed.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Dear Mr. LeVines:

This letter is in response to your public records request of 02/25/14, (attached), for records held by the Medical Use of Marijuana Program, within the Department of Public Health. The Program acknowledges your request and is currently in the process of identifying any records that meet the description contained in your request and that are subject to disclosure.

In your request for public records referenced above, you requested:

1. The RFP that DPH used to solicit bids for the outside firm that scored the medical marijuana applications, and the submitted bids DPH considered. Copies of any and all written guidance, rules, and/or regulations DPH or any DPH employee or director gave to ICF and/or the selection committee on scoring and evaluating the applications.

The Department charges the following fees for copies of public records:

* $.20 per page for photocopies;
* $.50 per page for computer printouts, including e-mails; and
* A pro-rated fee for staff time required to search for requested records, segregate or redact exempt information from non-exempt information, and for photocopying. This fee is based on the hourly rate of the lowest-paid employee capable of performing the task.
* The actual cost of postage.

You will be notified of the fee for producing any nonexempt, responsive records that have been identified, and upon receiving payment in the amount of the fee, the records will be made available to you.
