I, Marilyn Howard hereby request under MPIA any data collection activities inconjunction with (MCAC) Maryland Coordination Analysis Center, (ATAC) Maryland Antiterrorism Advisory Council, (SAR) Suspicious Activity Reporting and Fusion Center coordinated sharing and intelligence gathering with state and local agencies together with law enforcement partnership with public health (MEDAVAC) PREVENTING TERRORISM,  COUNTERING VIOLENT EXTREMISTS GROUPS AND INDIVIDUALS AND CRIME PREVENTION PROGRAMS).

Please provide relating to me any and all documents, video, photos, audios, and voice recordings of any daily activities. Any and all court orders, warrants, summons, supeanos NSL, police daily logs, police notes, ground and aerial surveillance including (SPYCOPTER AND USE OF SURVEILLANCE PLANES) intelligence gathering of all speech communications and electronic communications, iPhone, smart phones, cell phones and computers.

Please provide any and all multi jurisdictional coordinated efforts and data collection activities within Baltimore City, Baltimore County, Howard County, Montgomery County, and Prince Georges County.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

You indicated in your response dated on July 20, 2015 not more then (6) days later from my MPIA Request to to you on July 14, 2015 you had no records pertaining to my request.

However, you did not provide research method used, name of person(s) conducting search or what type of researched was completed by your agency.

According to your website, your center conduct antiterrorism, counterterrorism and crime prevention analysis through out the state of Maryland.

Please provide any and all data analysis technology from (2005 to present) that you conducted for Baltimore County, Howard County, Anne Arundel County, Montgomery County and Prince Georges County including Washington, D. C.

Also, provide any and all data records collected from ALPR (Automatic License Plate Reader) and (RIC) Regional Information Center databases and MCAC servers from (2005 to present) from private, commercial, federal, state and local government agency's.

Please provide method of research conducted, dates of files discarded, any and all applicable appeals or denial rights applicable to Maryland statutes.

You must respond within (30) days as required by Maryland MPIA Section 10-614 (b) or will be taken as a denial and will seek appropriate judicial relief.

You indicated in your letter dated August 17, 2015 in response to July 17, 2015 request for ALP Automatic License Plate reader documents are denied and provided MCAC Standard Operations and Procedures for ALPR program.

Under MPIA, a citizen is entitled to their personal records which I am requesting
any ALP reader information documents regarding me and my vehicles.

Also, please provide any data collected including any and all mass surveillance programs conducted in Maryland in collaboration with federal, state and local government and law enforcement regarding me that involve any threat analysis assessment regarding complaints against banks, government and police officials, colleges and etc for years beginning (2005 to present).

Recent MPIA documents released indicated your agency conducted surveillance activities during the Freddie Gray uprising on Malik Zulu Shabaaz, National President and activist of Black Lawyers For Justice, DOJ Police Complaint townhall community meetings, other protest rally's and protester's social media websites beginning (April 2015 to present).

Provide concerning me any and all data collected from any analysis threat assessment conducted in Baltimore City during Freddie Gray protests. Also, other data collection activities conducted in the state of Maryland including videos, audios photographs, computer and cell phone records, court orders, subpoenas, NSL and any audio recording records beginning from (2005 to present) in Baltimore County, MD.

You must respond within (30) days as required by Maryland MPIA Section 10-614 (b) or will be taken as a denial and will seek appropriate judicial relief.

I am in receipt of your response dated 09/01/2015 denying requested documents.

You are in violation for denial of requested documents, information and blatant denial of duties of your agency's role as indicated on your own (MCAC) website.

Pursuant to Maryland MPIA Section 10-614 (b) regarding Freddie Gray "First Amendment Protected Speech activities" that your agency (MCAC) gathered analysis and information for law enforcement agency's that I witnessed police air patrol units gathering data on me and other protestor at Malik Zulu Shabaaz, National President and activist of Black Lawyers For Justice, DOJ Police Complaint townhall community meetings, other protest rally's and protester's social media websites beginning (April 2015 to present).

I also requested any and all data records collected from ALPR (Automatic License Plate Reader) and (RIC) Regional Information Center databases and MCAC servers from (2005 to present) from private, commercial, federal, state and local agency's
including any tracking or any data collection of protestor's license plates during Freddie Gray protests in Baltimore city.

You denied requested documents and information under
(2) “Automatic license plate reader system” has the meaning stated in § 3-509 of the Public Safety Article.
(3) “Captured plate data” has the meaning stated in § 3-509 of the Public Safety Article.
Inspection of captured license plate data
(b) Except as provided in subsections (c) and (d) of this section, a custodian of captured plate data collected by an automatic license plate reader system shall deny inspection of the captured plate data.

This section does not apply with regards to Freddie Gray protest First Amendment Activities.

The following section states, PUBLIC SAFETY TITLE 3. LAW ENFORCEMENT
SUBTITLE 7. FREEDOM OF ASSOCIATION AND ASSEMBLY PROTECTION ACT. Md. PUBLIC SAFETY Code Ann. § 3-701 (2015)

§ 3-701. Law enforcement actions involving First Amendment activities

(5) "First Amendment activities" means:

(i) activities involving constitutionally protected speech or association; or

(ii) conduct related to freedom of speech, free exercise of religion, freedom of the press, the right to assemble, or the right to petition the government.

(j) Dissemination of information. --

(1) Information gathered and maintained by a law enforcement agency for intelligence purposes may be disseminated only to appropriate persons for legitimate law enforcement objectives in accordance with the law governing the release of police records and with procedures established by the law enforcement agency.

(2) This subsection may not be interpreted to diminish the rights of a person requesting information under the Maryland Public Information Act.

Your actions of denying requested information are in violation of MPIA.
