Pursuant to the Kentucky Open Records Act, I hereby request the following records:

1) Copies of all Predictive Model Reports provided to the university by EAB as part of its Student Success Collaborative product. These reports detail the predictive factors used to assign risk scores to students. A copy of an example report from another institution is attached for your reference.

2) All threshold reports provided to the university by EAB as part of its Student Success Collaborative product. A copy of an example report from another institution is attached for your reference.

3) Any differential impact analysis reports/studies compiled either by the university, EAB, or a third-party regarding EAB Student Success Collaborative's early warning system. These reports, sometimes called DIF or DIA studies, measure how the tools perform across different demographic or statistical groups.

I ask that all fees be waived as I am a journalist and I intend to use the requested records to publish articles in the public interest and not for any commercial purpose.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

We have identified responsive records, but these documents are withheld from release as they convey trade secrets, were created specifically for UofL, and contain unique formulas and information specific to the university. The release of these documents would give competitors substantially more than a trivial unfair advantage. Based on EAB's assertions below, the university declines to release these records.

Concerning Items 1 and 2: Risk Model Report and Threshold Report -EAB asserts these materials are protected from disclosure. Specifically, this information is confidential and proprietary, protected as trade secrets, and further protected from disclosure under KRS 61.878(1)(c)(1), as its disclosure would permit an unfair commercial advantage to competitors if released. EAB believes the studies and reports sought constitute trade secrets. EAB has taken reasonable measures to keep the information contained therein secret, including making claims that it is protected from state public disclosure laws and using contractual confidentiality provisions to protect these materials. The material sought also detail the means, methods, and overall approach of EAB's product, which is not otherwise readily ascertainable. EAB uses that information to provide its unique product and thus has independent economic value. Disclosing that information would cause substantial competitive and economic harm to EAB by competitors getting a detailed look at the behind-the-scenes functioning of our product, which they could then use to their economic benefit.

Regarding #3, I have not identified any records responsive to your request.
