Pursuant to the California Public Records Act, I hereby request information about the LA Metro's use of millimeter wave scanning devices, made by ThruVision. A news article describing the devices, and LA Metro's use of them, is available here: https://www.scientificamerican.com/article/will-l-a-s-anti-terrorist-subway-scanners-be-adopted-everywhere/.

Specifically, I am requesting the following documents:
1) A copy of any report or assessment written describing the results of the technology test conducted with the TSA.
2) A copy of the RFP put out by the Metro for the technology, and copies of all vendor responses received.
3) A copy of the contract signed with ThruVision.
4) Any policies describing how the technology is to be used, and any legal analyses or studies that may have been carried out which deal with the technology.
5) A copy of all technical documentation regarding the technology. Please search your records for user manuals, maintenance or service manuals, studies or reports, spec sheets or data sheets, or any other such documentation.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Hello, this is an appeal to a records request submitted under the California Public Records Act, in which I sought records relating to millimeter wave, or detection at range, devices.

First of all, thank you very much for your response in which you included many of the records which I sought. However, some records were excluded without explanation. Specifically, I requested five items in a numbered list (reproduced below). You provided records responsive to 1, 2, and 3, but did not include an records responsive to 4 and 5:
1) A copy of any report or assessment written describing the results of the technology test conducted with the TSA.
2) A copy of the RFP put out by the Metro for the technology, and copies of all vendor responses received.
3) A copy of the contract signed with ThruVision.
4) Any policies describing how the technology is to be used, and any legal analyses or studies that may have been carried out which deal with the technology.
5) A copy of all technical documentation regarding the technology. Please search your records for user manuals, maintenance or service manuals, studies or reports, spec sheets or data sheets, or any other such documentation.

Therefore, this appeal seeks records responsive to points 4 and 5, above.

To aid in your search, I have re-worded these item 4 in the hopes that it will be more clear and specific:
4) Department policy describing how the technology is to be used. If such a policy has been written, it might be found alongside your agency's policies for use of force, body worn cameras, etc. Furthermore, I am requesting legal analyses regarding the technology. Such an analysis or report may have been carried out by your agency's general counsel, or by a state attorney general.

As to item 5, my request remains the same, in the sense that I am seeking "user manuals, maintenance or service manuals, studies or reports, spec sheets or data sheets, or any other such documentation." However, your previous response contained some details which may be helpful. In particular, in the file img20181024_10574890_Redacted.pdf, you included a letter from Robert Pryor at TSA, in which he writes:

"TSA's extensive laboratory and field evaluations have demonstrated that the Thruvision TAC and QinetiQ SPO-NX are effective and suitable when employed in accordance with their capabilites and limitations, which have been reported by TSA and are also available upon request, and in conjunction with appropriate concepts of operations."

These documents, which describe the "capabilities and limitations" and "concepts of operations" of the system, are technical documentation. Please include them in your search. Furthermore, the statement of work with ThruVision reads,

"An 8-hour user training for Metro operators shall be conducted at Metro, both in the classroom and on the deployed site for the device."

Any documents produced from or for this training, such as handouts, syllabi, PowerPoint presentations, or training videos, are also technical documentation. Please include them in your search.

To summarize, thank you for the documents you have provided thus far. This appeal seeks records responsive to points 4 and 5, above, which were omitted from your previous response. In order to aid your search, I have provided some extra detail regarding those records. Please let me know if you have any questions, and thank you for your diligent work.
