From: George LeVines

To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

Any lists, databases and inventory rosters containing equipment used in the field of duty (i.e., firearms, protective gear, surveillance equipment, tactical and defense equipment, vehicles, etc).

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

George LeVines

A fix is required to perfect the request. The request has been rejected as being too vague, burdensome or otherwise unprocessable.

Chief Hurley,

I would turn your attention to the the Massachusetts Municipal Records Retention Manual. Specifically line item 16.023 (Equipment Inventory).

http://www.sec.state.ma.us/arc/arcpdf/MA_Municipal_Records_Retention_Manual.pdf

If that does not clarify this request enough I would like to know which inventory lists are most easily accessible to you and your staff. I was hoping — given the line item in the Retention Manual — that this request would be self evident. So that I might hone my request, perhaps you could elaborate on exactly how the department stays organized if in fact no "16.023 Equipment Inventory" exists.

Thank you for your time and diligence,

George

Mr. LeVines -

I would call your attention to the e-mail response I forwarded to you on May 28th in response to this same request. A good faith estimate was mailed to you in a letter dated May 21, 2013. It was mail on or about May 24th and was signed for by Muckrock.com on May 28th. See attached receipt. Once again per the Public Records Law the Leicester Police Department is awaiting payment from your organization in order to process your request. I have attached the delivery confirmation receipt indicating that the good faith estimate was delivered to Muckrock.com.

I am considering this matter closed until such time as the LPD receives payment for the requested documents.
