RE: October 18, 2016 Open Records Request.
Dear Mr. Thomas:
Pursuant to Iowa Code Section 22.7(5) (attached) peace officer's investigative reports "and specific portions of electronic email...if that information is part of an ongoing investigation..." are public records that shall be kept confidential. Iowa Code Section 22.7(5) (2016) ; see also Neer v. State, 798 N.W. 2d 349 (Iowa Ct. App.2011). Because the records you seek are part on an ongoing investigation and are confidential, they shall not be produced. Please contact me with any questions.
Very truly yours, Sheriff Jim Sholl

Sheriff Sholl,
What is the formal procedure for appealing the denial of a records request made to your department? I consider this denial to be improper and I wish to formally appeal. Thank you.
Sincerely,
